BILL NUMBER: S3024 SPONSOR: KENNEDY TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring passengers to use seatbelts in stretch limousines PURPOSE OR GENERAL IDEA OF BILL: To require passengers of stretch limousines to use seatbelts. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill adds a new paragraph (d) to subdivision 4 of section 1229-c of the vehicle and traffic law by adding a definition for "stretch limousine." Section 2 amends subdivision 9 of section 1229-c to apply the seatbelt requirements of this section to passengers of stretch limousines.

KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring passengers to use seatbelts in stretch limousines THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (b) and (c) of subdivision 4 of section 1229-c of the vehicle and traffic law, as separately amended by chapters 232 and 509 of the laws of 2004, are amended and a new paragraph (d) is added to read as follows: (b) "child restraint system" shall mean any device, used in conjunc- tion with safety belts, designed for use in a motor vehicle to restrain, seat, or position children and which meets the applicable Federal Motor Vehicle Safety Standards set forth in 49 C.F.R. 571.213; [and] (c) "appropriate child restraint system" shall mean a child restraint system for which the occupant meets the occupant size and weight recom- mendations of the manufacturer of such system[.]; AND (D) "STRETCH LIMOUSINE" SHALL MEAN ANY FOR HIRE VEHICLE WITH A CHASSIS WHICH WAS MANUFACTURED AND THEN ALTERED FOR THE PURPOSE OF TRANSPORTING TEN OR MORE OCCUPANTS, INCLUDING THE DRIVER. § 2. Subdivision 9 of section 1229-c of the vehicle and traffic law, as amended by chapter 340 of the laws of 2017, is amended to read as follows: 9. Notwithstanding the provisions of subdivision four of this section, the provisions of this section shall not apply to buses other than school buses AND STRETCH LIMOUSINES, and the provisions of subdivisions one, two, three and three-a of this section shall not apply to taxis and liveries. § 3.
