BILL NUMBER: S3620 SPONSOR: CARLUCCI TITLE OF BILL: An act to amend the education law, in relation to requiring panic alarms in schools PURPOSE OF BILL: Each public elementary and secondary school building shall be equipped with at least one panic alarm for use in a school security emergency including, but not limited to, a non-fire evacuation, lockdown, or active shooter situation and that the alarm will be directly linked to local law enforcement. SUMMARY OF PROVISIONS: Section one of the bill amends the education law by defining "emergency light" and "panic alarm." This section also requires all public elemen- tary and secondary public school buildings be equipped with at least one panic alarm for use in school security that would. be directly linked to local law enforcement authorities.

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring panic alarms in schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 409-m to read as follows: § 409-M. INSTALLATION OF PANIC ALARMS IN SCHOOLS. 1. AS USED IN THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "EMERGENCY LIGHT" MEANS A RED LIGHT THAT IS AFFIXED TO THE EXTERI- OR OF A SCHOOL BUILDING IN A HIGHLY VISIBLE LOCATION ABOVE OR NEAR THE FRONT ENTRANCE OR, IN THE CASE OF A SCHOOL BUILDING WHICH IS NOT CLEARLY VISIBLE FROM THE NEAREST PUBLIC ROADWAY, LOCATED ON THAT PUBLIC ROADWAY. (B) "PANIC ALARM" MEANS A SILENT SECURITY SYSTEM SIGNAL GENERATED BY THE MANUAL ACTIVATION OF A DEVICE INTENDED TO SIGNAL A LIFE-THREATENING OR EMERGENCY SITUATION REQUIRING A RESPONSE FROM LAW ENFORCEMENT. 2. EACH PUBLIC ELEMENTARY AND SECONDARY SCHOOL BUILDING SHALL BE EQUIPPED WITH AT LEAST ONE PANIC ALARM FOR USE IN A SCHOOL SECURITY EMERGENCY INCLUDING, BUT NOT LIMITED TO, A NON-FIRE EVACUATION, LOCK- DOWN, OR ACTIVE SHOOTER SITUATION. THE ALARM SHALL BE DIRECTLY LINKED TO LOCAL LAW ENFORCEMENT AUTHORITIES OR, IN THE CASE OF A SCHOOL BUILDING LOCATED IN A MUNICIPALITY IN WHICH THERE IS NO MUNICIPAL POLICE DEPART- MENT, A LOCATION DESIGNATED BY THE SUPERINTENDENT OF STATE POLICE, AND SHALL IMMEDIATELY TRANSMIT A SIGNAL OR MESSAGE TO SUCH AUTHORITIES UPON ACTIVATION. THE ALARM SHALL NOT BE AUDIBLE WITHIN THE SCHOOL BUILDING. 3. EACH PUBLIC ELEMENTARY AND SECONDARY SCHOOL BUILDING SHALL BE EQUIPPED WITH AN EMERGENCY LIGHT THAT IS LINKED TO THE SCHOOL'S PANIC ALARM AND WHICH TURNS ON WHEN THE PANIC ALARM IS ACTIVATED. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
