BILL NUMBER: S3810 REVISED 05/13/19 SPONSOR: LAVALLE PURPOSE: This bill would grant more equitable disability pensions to airport firefighters and training and safety officers in New York State division of military and naval affairs who sustain a disability related to heart disease, lung disease and certain forms of cancer. SUMMARY OF PROVISIONS: Section one amends the retirement and social security law by adding two new sections 63-g and 63-h which establish that any member of the retirement system employed by the division of military and naval affairs shall be eligible to retire pursuant to the provisions of this section if he or she is an airport firefighter apprentice, firefighter I, airport firefighter II, airport firefighter III or training and safety officer. LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to the issuance of a superintendent's certificate to persons possessing exceptional quali- fications THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3003 of the education law is amended by adding a new subdivision 3-a to read as follows: 3-A. A. THE COMMISSIONER, AT THE REQUEST OF A BOARD OF EDUCATION OR BOARD OF COOPERATIVE EDUCATIONAL SERVICES, SHALL PROVIDE FOR THE ISSU- ANCE OF A SUPERINTENDENT'S CERTIFICATE TO ANY PERSON POSSESSING EXCEP- TIONAL QUALIFICATIONS IN SPECIFIC BUSINESS OPERATIONS WHO DOES NOT MEET ALL OF THE GRADUATE COURSE OR TEACHING REQUIREMENTS OF SUBDIVISION ONE OF THIS SECTION. FOR PURPOSES OF THIS SUBDIVISION "EXCEPTIONAL QUALI- FICATIONS" MEANS THE CANDIDATE HAS EARNED A POST GRADUATE DEGREE FROM AN ACCREDITED COLLEGE OR UNIVERSITY AND HAS AT LEAST FIVE YEARS EXPERIENCE AS CHIEF EXECUTIVE OFFICER OF A COMPANY OR ORGANIZATION. THE SIZE OF EMPLOYEE WORK FORCE AND ANNUAL SALES OR OPERATING REVENUES OF SUCH COMPANY SHALL BE FACTORS CONSIDERED IN THE ISSUANCE OF SUCH A CERTIF- ICATE. B. ANY SUPERINTENDENT RECEIVING HIS OR HER CERTIFICATE AS SUPERINTEN- DENT OF SCHOOLS PURSUANT TO PARAGRAPH A OF THIS SUBDIVISION SHALL COMPLETE TWELVE SEMESTER HOURS OF GRADUATE STUDY IN THE FIELD OF SCHOOL ADMINISTRATION AND SUPERVISION WITHIN TWO YEARS OF RECEIPT OF HIS OR HER CERTIFICATE. § 2.
