BILL NUMBER: S4053 SPONSOR: ANTONACCI TITLE OF BILL: An act to amend the state finance law, in relation to state procurement oversight PURPOSE: To enhance the integrity, transparency and accountability of the State procurement process JUSTIFICATION: The recent criminal charges filed by the US Attorney relating to the way the upstate economic development programs have been managed are a trou- bling reminder that the lack of independent oversight for procurements creates an environment ripe for corruption, bid rigging and kickbacks. Billions of State dollars are being funneled by State agencies and authorities to third party entities, allowing for the circumvention of longstanding checks and balances that protect taxpayers and ensure a level playing field for bidders. ANTONACCI -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to state procurement oversight THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state finance law is amended by adding a new section 161-a to read as follows: § 161-A. STATE PROCUREMENT AND PUBLIC WORK OVERSIGHT PANEL. THERE SHALL BE A STATE PROCUREMENT AND PUBLIC WORK OVERSIGHT PANEL CHARGED WITH THE INDEPENDENT OVERSIGHT OF ALL STATE PROCUREMENTS AND PUBLIC WORKS OF TEN MILLION DOLLARS OR MORE BY ALL STATE AGENCIES AND STATE AUTHORITIES. THE PANEL SHALL CONSIST OF FIVE MEMBERS; ONE EACH APPOINTED BY THE GOVERNOR, THE COMPTROLLER, THE ATTORNEY GENERAL, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY. THE PANEL SHALL MAKE RECOMMENDATIONS TO THE LEGISLATURE TO ENSURE THE WISE AND PRUDENT USE OF PUBLIC MONEY IN THE BEST INTERESTS OF THE TAXPAYERS OF THE STATE AND GUARD AGAINST FAVORITISM, IMPROVIDENCE, EXTRAVAGANCE, FRAUD AND CORRUPTION IN CONNECTION WITH LARGE PROCUREMENTS AND PUBLIC WORKS OF STATE AGENCIES AND STATE AUTHORITIES. THE PANEL SHALL REVIEW EACH AND EVERY PROCUREMENT AND PUBLIC WORK BY A STATE AGENCY AND AUTHORITY OF TEN MILLION DOLLARS OR MORE AT KEY INTERVALS OF THE PROCUREMENT PROCESS, INCLUDING BUT NOT LIMITED TO THE FINAL AWARD, TO ENSURE THE PROCESS IS OPEN, FAIR AND COMPETITIVE. THE STATE AGENCY OR AUTHORITY IN CHARGE OF THE PROCUREMENT OR PUBLIC WORK SHALL FULLY ASSIST THE PANEL IN ITS REVIEW AND PROMPTLY PROVIDE ANY INFORMATION AND DOCUMENTATION NEEDED OR REQUESTED BY THE PANEL TO CONDUCT ITS REVIEW. THE PANEL MAY RECOMMEND UTILIZATION OF OTHER STATE AGENCIES OR AUTHORITIES TO ASSIST PROJECT MANAGEMENT TO ENSURE ON-TIME ON-BUDGET DELIVERY. § 2. This act shall take effect immediately.
