BILL NUMBER: S4178 SPONSOR: ANTONACCI TITLE OF BILL: An act to amend the general business law, in relation to providing that no business shall be prohibited from adopting a zero tolerance drug policy PURPOSE: This bill establishes that businesses within New York State shall not be prohibited from adopting or operating under a zero tolerance drug policy for its employees. SUMMARY OF PROVISIONS: Section 1 - amends the general business law by adding a new section 399-hh. Section 2 - establishes an effective date.

ANTONACCI -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to providing that no business shall be prohibited from adopting a zero tolerance drug policy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 399-hh to read as follows: § 399-HH. ZERO TOLERANCE DRUG POLICY. 1. NO PERSON, CORPORATION, PART- NERSHIP, LIMITED LIABILITY COMPANY, FIRM OR ANY OTHER BUSINESS ENTITY DOING BUSINESS WITHIN THIS STATE SHALL BE PROHIBITED, BY LAW, RULE, REGULATION OR BY ANY OTHER MEANS, FROM ADOPTING OR OPERATING UNDER A ZERO TOLERANCE DRUG POLICY FOR ITS EMPLOYEES. 2. FOR PURPOSES OF THIS SECTION, THE TERM "ZERO TOLERANCE DRUG POLICY" SHALL MEAN A BUSINESS POLICY WHICH IMPOSES STRICT PUNISHMENT OR JOB TERMINATION FOR ITS EMPLOYEES FOR THE USE OR POSSESSION OF DRUGS IN THE WORKPLACE WHILE PROHIBITING PERSONS OF AUTHORITY FROM USING DISCRETION IN DETERMINING PUNISHMENT FOR SUCH USE OR POSSESSION. § 2.
