TITLE OF BILL:  An act to amend the vehicle and traffic law, in
relation to exempting certain ATVs from registration requirements

 
PURPOSE:

This legislation will afford to ATV (all-terrain vehicle) owners the
same registration exemptions as currently afforded snowmobile owners in
New York State.

 
SUMMARY OF PROVISIONS:

Section 1 of the bill adds a new paragraph (c) to Subdivision 11 of
section 2282 of the vehicle and traffic law.

 
EXISTING LAW:

Currently, in New York State, the owner of an ATV must register his or
              

her vehicle even if it is driven only on private property.

 
JUSTIFICATION:

Current New York State law provides three exemptions from the require-
ment to register snowmobiles. They are: 1) snowmobiles owned and used by
the United States; 2) snowmobiles registered in another state or coun-
try; and 3) snowmobiles operated on lands owned by the owner or to which
the owner has certain contractual rights. New York State law pertaining
to ATVs provides only the first two exemptions.  An owner of an ATV must
register the vehicle, even if it is only used on his or her private
property, creating hardship for some owners. While the vehicle may never
leave the owner's private property, that individual can be cited for
violating state law. In contrast, if a snowmobile is similarly used, no
law is broken. The bill seeks to address the inequity in the law.
