TITLE OF BILL:  An act to amend the public health law, in relation to
healthcare and wellness education and outreach programs on the donation
of postnatal tissue and fluids

 
PURPOSE:

To encourage and establish awareness for the options for donation of
postnatal tissue and fluids.

 
SUMMARY OF PROVISIONS:

Amends Subdivision 1 of section 207 of the public health law, by adding
a new paragraph (p) which would allow the department to conduct educa-
tion and outreach programs that relate to donation of postnatal tissue
and fluids.

 
JUSTIFICATION:

Postnatal tissue and fluids include the placenta, umbilical cord, and
amniotic fluid. These tissue and fluids can be used to benefit and heal
patients with a variety of medical needs.  Umbilical cord blood, the
blood that remains in a newborn's umbilical cord after birth, is a rich
source of undifferentiated biological cells. Cord blood cells, which
generally do not require a perfect match, have already been used in
treating over 20,000 patients for a wide range of diseases, including
types of leukemia, sickle-cell anemia, immunodeficiency, marrow failure
and genetic diseases that call for transplants. It is also being clin-
ically tested for treatments of other disorders including Type 1
Diabetes and Cerebral Palsy as well as studies to reverse hearing loss
in infants and toddlers, utilizing undifferentiated biological cells
from cord blood to repair damaged inner ears.

Tissue grafts derived from birth tissue help native tissue restoration
and remodeling, and provide a protective and physical barrier when
applied to wounds. These tissue grafts are used to treat wounds such as
diabetic foot ulcers and burn injuries.

Unfortunately, these lifesaving resources are normally discarded after
birth. The State has an interest in ensuring that valuable information
about the donation of postnatal tissue and fluid is made available to
the public through education and outreach programs. This bill would
allow the department of health to conduct such education and outreach
programs.

 AN ACT to amend the public health law, in  relation  to  healthcare  and
   wellness  education and outreach programs on the donation of postnatal
   tissue and fluids

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  1 of section 207 of the public health law is
 amended by adding a new paragraph (p) to read as follows:
   (P) POSTNATAL DONATION OF TISSUE AND FLUIDS.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law. Effective immediately the  addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
