BILL NUMBER: S5474 SPONSOR: MAY TITLE OF BILL: An act to amend the election law, in relation to filing name of new political party PURPOSE: The purpose of this legislation is to establish a deadline date to file a first certificate for a new party. SUMMARY OF PROVISIONS: Section 1. Subdivision 1 of section 2-124 of the election law is amended by adding that a new party shall file such first certificate not later than the last day of February following the election at which the party obtained party status. Section 2. Establishes the effective date.

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to filing name of new political party THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 2-124 of the election law is amended to read as follows: 1. The state committee of a party shall select a name and emblem to distinguish the candidates of the party for public office in all districts of the state, and shall file in the office of the state board of elections, a certificate executed by its chairman and secretary, setting forth the name and showing the emblem so selected. A NEW PARTY SHALL FILE SUCH FIRST CERTIFICATE NOT LATER THAN THE LAST DAY OF FEBRU- ARY FOLLOWING THE ELECTION AT WHICH THE PARTY OBTAINS PARTY STATUS AND SHALL TAKE EFFECT UPON FILING. ANY OTHER CERTIFICATE FILED CHANGING THE NAME OF A PARTY SHALL TAKE EFFECT ON THE LAST DAY OF JANUARY AFTER THE NEXT GUBERNATORIAL ELECTION. § 2. This act shall take effect on the first of January after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
