TITLE OF BILL:  An act authorizing the city of Albany to alienate
certain lands used as parkland and to dedicate certain other lands as
parklands

 
PURPOSE:

To alienate a portion of Lincoln Park to allow for the construction and
maintenance of a new underground pipe through Lincoln Park to Morton
Avenue. These lands in conjunction with the lands previously alienated
for the construction of the screening and disinfection facility will
define the limits of total park lands which need to be alienated for the
Project.

Under the legislation, consistent with other requirements of law, the
city of Albany will dedicate an amount equal to or greater than the fair
market value of the parklands being discontinued towards the acquisition
of new parklands and/or capital improvements to existing park and recre-
ational facilities.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 authorizes the City of Albany to alienate the parkland for the
purpose of the provision of underground piping through Lincoln Park in
connection with the disinfection and floatables control project, and
associated infrastructure, also known as the Beaver Creek Clean River
Project (screening and disinfection satellite treatment facility).

Section 2 requires the city of Albany to dedicate an amount equal to or
greater than the fair market value of the parklands being discontinued
towards the acquisition of new parklands and/or capital improvements to
existing park and recreational facilities.

Section 3 describes the relevant parkland and specifies acreage and
borders.

Section 4 requires the city of Albany, if it received any funding
support or assistance from the federal government for the purchase,
maintenance or improvement of the parklands set forth in section three
of this act, the discontinuance and alienation of such parkland author-
ized by the provisions of this act shall not occur until the city of
Albany has complied with any federal requirements, pertaining to the
alienation or conversion of such parklands, including satisfying the
secretary of the interior that the alienation or conversion complies
with all conditions which the secretary of the interior deems necessary
to assure the substitution of other lands shall be equivalent in fair
market value and usefulness to the lands being alienated or converted.

Section 5 provides that the act shall take effect immediately.

 
JUSTIFICATION:

The Lincoln Park Clean River Project, part of the Albany Pool Combined
Sewer Overflow Long Term Control Plan, is required to be constructed
under an effective Order on Consent between the Albany Water Board and
Department of Environmental Conservation. The Project provides for the
screening and disinfection of wet weather flows for the Beaver Creek
Sewer District, and is intended to improve the water quality of the
Hudson River.

As part of the development for the Project, the Albany Water Board has
conducted an extensive public education and outreach program.  In order
to address public concerns relative. to the removal and storage of solid
materials in the park, a partnership between the Albany Water Board and
the Albany County Water Purification District (ACWPD) was formed. Under
this partnership, solid materials which are screened in the park will be
conveyed directly to the ACWPD South Treatment Plant where they will be
removed and processed. The conveyance of the screened materials requires
a new direct connection from the proposed screening and disinfection
facility to the Albany County Hudson River Interceptor. The selected
routing for this new connection will run through Lincoln Park to Morton
Avenue and then along South Hawk Street where it will connect to an
existing pipe on Third Avenue and ultimately the County's interceptor
sewer.  In addition, provisions have been incorporated into the Project
for improved circulation of traffic and parking; along with the relo-
cation of the existing access drive between Delaware Avenue and Dr.
Martin Luther King, Jr. Boulevard.

The proposed modifications to the Project will require that additional
parklands to be alienated. Areas impacted due to the improved traffic
circulation and parking, as well as the relocated access drive, are
defined in the Phase 1A map and description. Areas required to construct
and maintain the new underground pipe connection through Lincoln Park to
Morton Avenue are designated in the Phase 2 map and description. These
lands in conjunction with the lands previously alienated for the
construction of the screening and disinfection facility will define the
limits of total park lands which need to be alienated for the Project.

 AN ACT authorizing the city of Albany to alienate certain lands used  as
   parkland and to dedicate certain other lands as parklands
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act, the city of  Albany,
 Albany  county,  acting  by  and  through  its governing body, is hereby
 authorized to discontinue the use of parklands and alienate  such  lands
 more  particularly  described  in  section  three  of  this act, for the
 purpose of constructing and maintaining a new underground  pipe  through
 Lincoln  Park in connection with the disinfection and floatables control
 project, and associated infrastructure, also known as the  Beaver  Creek
 Clean  River  Project  (screening  and  disinfection satellite treatment
 facility), within such parklands, and upon such other terms  and  condi-
 tions as determined by the governing body of the city of Albany.
   § 2. The authorization contained in section one of this act shall take
 effect only upon the condition that the city of Albany shall dedicate an
 amount  equal  to or greater than the fair market value of the parklands
 being discontinued towards the acquisition of new parklands and/or capi-
 tal improvements to existing park and recreational facilities.
   § 3. The parklands authorized by section one of this act to be discon-
 tinued as parklands are described as follows:
   All that tract or parcel of land situate in the City of Albany, County
 of Albany, and State of New York more particularly bounded and described
 as follows:
   Parcel 1A-2019
   Commencing at a point on the westerly street boundary of Martin Luther
 King Jr. Boulevard at its intersection with the southerly street bounda-
 ry of Park Avenue and running along the said westerly street boundary of
 Martin Luther King Jr. Boulevard a distance of 235± feet to the point of

 complied with any federal requirements pertaining to the  alienation  or

 which  the  secretary  of  the  interior  deems  necessary to assure the
 substitution of other lands shall be equivalent in fair market value and
 usefulness to the lands being alienated or converted.
   § 5. This act shall take effect immediately.

This bill makes technical corrections to the metes and bounds in Chapter
450 of 2018.

 ALL that certain piece or parcel of land located in the City of  Albany,
 County  of Albany, State of New York and being more particularly bounded
 and described as follows:
 PARCEL 1
 Commencing at a point on the westerly street boundary of  Martin  Luther
 King Jr. Boulevard at its intersection with the southerly street bounda-
 ry of Park Avenue and running along the said westerly street boundary of
 Martin Luther King Jr. Boulevard a distance of 235± feet to the point of
 beginning  of  the herein described Parkland Alienation Parcel 1; thence
 continuing along said westerly street boundary of Martin Luther King Jr.
 Boulevard the following two (2) courses and distances:
