BILL NUMBER: S563 SPONSOR: KAMINSKY TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibiting the use of certain grades of fuel oil PURPOSE OR GENERAL IDEA OF BILL: To phase out the use of grade 6 heating oil fuel in state, county, and local government owned buildings. SUMMARY OF PROVISIONS: The Environmental Conservation Law is amended by adding a new section 19-0329 to completely phase out the use of fuel Grade 6 in any state, county or local government owned building, but makes clear that nothing in this act shall preempt a municipality from adopting a more stringent law. KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the use of certain grades of fuel oil THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 19-0329 to read as follows: § 19-0329. CERTAIN FUEL OIL; PROHIBITED. 1. ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-ONE, NO FUEL OIL, GRADE NUMBER SIX, AS CLASSIFIED BY AMERICAN SOCIETY FOR TESTING MATERI- ALS STANDARD D396-15C, SHALL BE USED IN ANY BUILDING OR FACILITY IN THE STATE. 2. NOTHING IN THIS SECTION SHALL PREVENT A MUNICIPALITY FROM ADOPTING A LAW, CODE, ORDINANCE OR REGULATION WHICH IS MORE STRINGENT THAN THE REQUIREMENTS OF THIS SECTION. § 2.
