BILL NUMBER: S5788 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the public health law, in relation to the regulation of smoking and vaping on the grounds and other outdoor areas of public colleges and universities PURPOSE: To prohibit smoking and vaping on the grounds of public colleges and universities. SUMMARY OF PROVISIONS: Section one adds colleges and universities to the list of eligible institutions for preexisting school-based programs to prevent and reduce tobacco use. Section two amends the clean outdoor air act to outlaw smoking or vaping on the grounds of public colleges and universities.

STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the regulation of smoking and vaping on the grounds and other outdoor areas of public colleges and universities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph b of subdivision 2 of section 1399-ii of the public health law, as added by chapter 1 of the laws of 1999, is amended to read as follows: (b) School-based programs, INCLUDING THOSE LOCATED AT COLLEGES AND UNIVERSITIES, to prevent and reduce tobacco use; § 2. Subdivision 2 of section 1399-o of the public health law is amended by adding a new paragraph c to read as follows: C. ON THE GROUNDS OR OTHER OUTDOOR AREAS OF ANY PUBLIC COLLEGE OR UNIVERSITY THAT ARE OWNED, LEASED OR OPERATED BY SUCH COLLEGE OR UNIVER- SITY. § 3. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11718-01-9
