BILL NUMBER: S5867 SPONSOR: RIVERA TITLE OF BILL: An act to amend the public health law, in relation to treatment alternatives for pain causing conditions SUMMARY OF PROVISIONS OF BILL: Section 1 of the bill amends section 3331 of the public health law to require a practitioner to discuss nonpharmacological treatment alterna- tives with a patient before prescribing an opioid, provided such requirement shall not apply for certain patients such as cancer, hospice, post-surgery or medical emergencies. Section 2 provides an effective date. JUSTIFICATION: According to the 2018 New York State Opioid Annual Data report prepared by the New York State Department of Health, "(o)pioid overdose deaths among New York State residents increased sharply in 2015 and 2016. Section 3331 of the public health law is amended by adding a new subdivision 9 to read as follows: 9. (A) WHEN A PATIENT SEEKS TREATMENT FOR ANY NEUROMUSCULOSKELETAL CONDITION THAT CAUSES PAIN, A PRACTITIONER SHALL REFER, DISCUSS AND/OR PRESCRIBE ANY OF THE FOLLOWING NONPHARMACOLOGICAL TREATMENT ALTERNA- TIVES, BASED ON THE PRACTITIONER'S CLINICAL JUDGMENT AND FOLLOWING GENERALLY ACCEPTED NATIONAL PROFESSIONAL OR TREATMENT GUIDELINES, BEFORE STARTING A PATIENT ON AN OPIOID: ACUPUNCTURE, CHIROPRACTIC, MASSAGE THERAPY, PHYSICAL THERAPY OR OCCUPATIONAL THERAPY. (B) THIS SUBDIVISION SHALL NOT APPLY TO THE USE OF OPIOIDS FOR PATIENTS BEING TREATED UNDER ANY OF THE FOLLOWING CIRCUMSTANCES: TREAT- MENT OF CANCER; HOSPICE CARE; MEDICAL TREATMENT IN A LONG-TERM CARE FACILITY; POST-SURGERY TREATMENT IMMEDIATELY FOLLOWING A SURGICAL PROCE- DURE; OR IN A MEDICAL EMERGENCY SITUATION. FOR PURPOSES OF THIS ARTICLE, A "MEDICAL EMERGENCY SITUATION" SHALL MEAN AN ACUTE INJURY OR ILLNESS THAT POSES AN IMMEDIATE RISK TO A PERSON'S LIFE OR LONG-TERM HEALTH. § 2. It requires that a practitioner treating a patient with a neuromusculosk- eletal condition that causes pain consider, discuss, and, if appropri- ate, refer or prescribe non-opioid treatments before prescribing an opioid. This requirement would not apply in a medical emergency, immedi- ate post-surgical care, hospice or other end-of-life care, or cancer treatment, though it does not preclude non-opioid treatment options in those circumstances.
