BILL NUMBER: S6032 SPONSOR: GAUGHRAN TITLE OF BILL: An act to amend the penal law, in relation to desig- nating crimes against public protection professionals PURPOSE: The purpose of this bill is to enhance public safety by deterring crimi- nal acts that target public protection professionals based on an actual or perceived belief that their victim is a police officer, peace offi- cer, firefighter, emergency service worker, judge, district attorney, member of the military or reserves, or a veteran. SUMMARY OF PROVISIONS: Section One adds a new Title Y-3 (Article 497) to the Penal Law, enti- tled Crimes Against Public Protection Professionals. GAUGHRAN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to designating crimes against public protection professionals THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Part 4 of the penal law is amended by adding a new title Y-3 to read as follows: TITLE Y-3 CRIMES AGAINST PUBLIC PROTECTION PROFESSIONALS ARTICLE 497 CRIMES AGAINST PUBLIC PROTECTION PROFESSIONS SECTION 497.00 DEFINITIONS. 497.05 CRIMES AGAINST PUBLIC PROTECTION PROFESSIONAL. 497.10 SENTENCING. § 497.00 DEFINITIONS. AS USED IN THIS TITLE: 1. "PUBLIC PROTECTION PROFESSIONAL" MEANS AN ACTIVE OR FORMER POLICE OFFICER AS DEFINED IN SUBDIVISION THIRTY-FOUR OF SECTION 1.20 OF THE CRIMINAL PROCEDURE LAW, PEACE OFFICER AS DEFINED IN SUBDIVISION THIRTY- THREE OF SECTION 1.20 OF THE CRIMINAL PROCEDURE LAW, FIREFIGHTER, EMER- GENCY SERVICES PERSONNEL BOTH PAID AND VOLUNTEER, JUDGE AS DEFINED IN SUBDIVISION TWENTY-THREE OF SECTION 1.20 OF THE CRIMINAL PROCEDURE LAW, DISTRICT ATTORNEY, A MEMBER OF THE MILITARY OR RESERVES, OR A VETERAN. 2. "FIREFIGHTER" MEANS A PAID OR VOLUNTEER MEMBER OF A FIRE COMPANY OR FIRE CORPORATION. 3. "EMERGENCY SERVICES PERSONNEL" MEANS AN INDIVIDUAL ENGAGED IN PROVIDING EMERGENCY MEDICAL SERVICES AND THE TRANSPORTATION OF SICK, DISABLED OR INJURED PERSONS TO OR FROM FACILITIES OFFERING HOSPITAL SERVICES.
