Provides that certain monies received by the comptroller be deposited into a special revenue fund to be known as the displaced homemakers fund; institutes an additional $10 fee for initiating a matrimonial action, such funds shall be deposited in the fund; provides further that such monies be made available generally for costs and expenses of the commissioner of labor in administering the provisions of the displaced homemakers act.

TITLE OF BILL:

An act to amend the labor law, the state finance law and the civil prac-
tice law and rules, in relation to displaced homemakers

 
PURPOSE:

In order to increase revenues for the displaced homemaker program.  This
bill: (1 )amends the state finance law to establish a displaced homemak-
er fund from fees collected from divorce filings: such monies will be
available to the Industrial Commissioner, subject to legislative author-
ization, to augment revenues received by these programs from other
sources and (2)amends CPLR to require a $10 fee on all divorce filings.
Funds will be under the State Comptroller's jurisdiction.

 
SUMMARY OF PROVISIONS:

Section 825, subdivision 1 of the labor law and adds a new section 99-q

to the finance law.

 
JUSTIFICATION:

Many individuals, left on their own through divorce, separation or death
of a spouse, are forced into the business world but lack the necessary
skills to find a job. This legislation would set up a fund, through a
$10 divorce filing fee, for these "displaced homemakers" to learn skills
which would enable them to enter or re-enter the work force. They would
be then self supporting and this would eliminate the need for public
assistance Similar legislation was passed in the States of Colorado,
Idaho, Minnesota, Montana, North Dakota, Utah and Washington. A needs
assessment program conducted by the State Education Department documents
the fact that there are approximately 1,008,816 displaced homemakers in
the State, but due to lack of funds only 90,000 have been reached by the
program. Passage of this legislation would be most cost effective
because it would generate approximately $629,240.00 that would allow
hundreds of displaced homemakers to utilize the program thus removing
them from public assistance and saving taxpayers thousands of dollars
each year This figure is achieved by multiplying the number of divorces
for 1988: 62,924 by $10 a divorce.

 AN ACT to amend the labor law, the state finance law and the civil prac-
   tice law and rules, in relation to displaced homemakers
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  opening paragraph of subdivision 1 of section 825 of
 the labor law, as added by chapter 717 of the laws of 1977,  is  amended
 to read as follows:
   Upon  receipt  of federal funding designated to assist displaced home-
 makers, AS AUGMENTED BY REVENUES RECEIVED FROM THE DISPLACED  HOMEMAKERS
 FUND AS PROVIDED IN SECTION NINETY-NINE-HH OF THE STATE FINANCE LAW, the
 commissioner  shall establish multipurpose service centers for displaced
 homemakers which shall provide the following:
   § 2. The state finance law is amended by adding a new section 99-hh to
 read as follows:
   § 99-HH. DISPLACED HOMEMAKERS FUND. 1.  ALL  MONIES  RECEIVED  BY  THE
 COMPTROLLER  PURSUANT TO SUBDIVISION (A) OF SECTION EIGHT THOUSAND EIGH-
 TEEN OF THE CIVIL PRACTICE  LAW  AND  RULES  SHALL  CONSTITUTE  A  STATE
 SPECIAL  REVENUE  FUND, TO BE HELD BY THE COMPTROLLER AND TO BE KNOWN AS
 THE DISPLACED HOMEMAKERS FUND. SUCH STATE SPECIAL REVENUE FUND SHALL  BE
 DEPOSITED  TO  THE CREDIT OF THE COMPTROLLER IN ONE OR MORE STATE BANKS,
 TRUST COMPANIES OR SAVINGS BANKS AS MAY BE DESIGNATED BY THE COMPTROLLER
 AT SUCH RATE OF INTEREST, IF ANY, AS FROM TIME TO  TIME  MAY  BE  AGREED
 UPON BY THE DEPOSITORIES AND THE COMPTROLLER.
   2.  MONIES  OF  THE  FUND  SHALL  BE AVAILABLE GENERALLY FOR COSTS AND
 EXPENSES OF THE COMMISSIONER OF LABOR IN ADMINISTERING THE PROVISIONS OF
 ARTICLE TWENTY-THREE-B OF THE LABOR LAW.
   3. THE MONIES SHALL BE PAID OUT OF THE FUND ON THE AUDIT  AND  WARRANT
 OF THE COMPTROLLER ON VOUCHERS CERTIFIED BY THE COMMISSIONER OF LABOR OR
 HIS OR HER DULY DESIGNATED OFFICER.

   §  3.  Subdivision  (a)  of section 8018 of the civil practice law and
 rules is amended by adding a new paragraph 4 to read as follows:
   4.  IN  ADDITION  TO THE FEES OTHERWISE PROVIDED IN THIS SUBDIVISION A
 COUNTY CLERK SHALL COLLECT FROM ANY  PERSON  INSTITUTING  A  MATRIMONIAL
 ACTION  AN  ADDITIONAL  FEE OF TEN DOLLARS. SUCH ADDITIONAL FEE SHALL BE
 REMITTED TO THE COMPTROLLER AND DEPOSITED IN  THE  DISPLACED  HOMEMAKERS
 FUND  PURSUANT  TO  SECTION  NINETY-NINE-HH  OF  THE  STATE FINANCE LAW.
 PROVIDED, HOWEVER, SUCH ADDITIONAL FEE SHALL NOT  BE  COLLECTED  FROM  A
 POOR  PERSON WHO PROCEEDS PURSUANT TO SECTION ELEVEN HUNDRED ONE OF THIS
 CHAPTER.
   § 4. This act shall take effect on the first of April next  succeeding
 the date on which it shall have become a law.
