TITLE OF BILL:  An act in relation to qualifications for the design of
a nitrogen-reducing sewage disposal system in a county of one million or
more which draws its primary source of drinking water for a majority of
county residents from a designated sole source aquifer

 
PURPOSE:

Provides an exemption from the requirements of Section 7208 of the
Education Law for land surveyors and persons holding a valid license
from Nassau or Suffolk County to design the replacement or retrofit of a
pre-manufactured sewage disposal system on an individual residential
lot.

 
SUMMARY OF PROVISIONS:

Section 1. Limits the provisions of this act to Nassau and Suffolk Coun-
ties.

Section 2. Relates to an exemption from Section 7208 of the Education
Law for land surveyors to design sewage disposal systems for replacement
or retrofit on an individual residential lot

Section 3. Relates to an exemption from Section 7208 of the Education
Law for persons holding valid licenses to design sewage disposal systems
for replacement or retrofit on an individual residential lot

Section 4: Severability Clause

Section 5. Provides for an immediate effective date.

 
JUSTIFICATION:

Under current law, plans for the installation of pre-manufactured nitro-
gen-reducing sewage disposal systems must be approved by a registered
architect or professional engineer before being handed over to an
installation company. This requirement results in delays and increased
costs that deter property owners from moving forward with upgrading
aging septic systems despite the availability of grant opportunities. To
ensure that the design services are affordable and that companies are
available to complete designs without significant project delays, this
legislation provides for an exemption from Section 7208 of the Education
Law to allow land surveyors and holders of a valid license by the county
to design the replacement or retrofit of pre-manufactured nitrogen
reducing sewage disposal systems that are approved by the county depart-
ment of health with a design flow of less than 1,000 gallons per day on
an individual residential lot.

 AN ACT in relation to qualifications for the design of a nitrogen-reduc-
   ing sewage disposal system in a county of one million  or  more  which
   draws  its  primary  source of drinking water for a majority of county
   residents from a designated sole source aquifer
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Notwithstanding any provision of law to the contrary, the
 provisions of this act shall apply to a county with a population of  one
 million  or  more which draws its primary source of drinking water for a
 majority of county residents from a designated sole source aquifer.
   § 2. Where a nitrogen-reducing sewage disposal system, approved by the
 county department of health, is designed by a land surveyor for an indi-
 vidual residential lot, said land surveyor shall  constitute  an  exempt
 person under section 7208 of the education law. This section shall apply
 to  sewage disposal systems where the design flow is less than one thou-
 sand gallons per day.
   § 3. Where a nitrogen-reducing sewage disposal system, approved by the
 county department of health for replacement or retrofit on an individual
 residential lot, is designed by a person who holds a valid license  from
 the county to design sewage disposal systems for replacement or retrofit
 on an individual residential lot, said person shall constitute an exempt
 person under section 7208 of the education law. This section shall apply
 to  sewage disposal systems where the design flow is less than one thou-
 sand gallons per day.
   § 4. Severability. The provisions of this act shall be  severable  and
 if  any  portion  thereof  or the applicability thereof to any person or
 circumstances shall be held invalid, the remainder of this act  and  the
 application thereof shall not be affected thereby.
   § 5. This act shall take effect immediately.

PURPOSE:

Relates to the stamping of the seals of land surveyors and engineers on
plans for the location of nitrogen reducing sewage disposal systems
approved for use by the Department of Health in Nassau and Suffolk Coun-
ties that are upgrades of existing sewage disposal systems and cesspools
where the design flow is one thousand gallons or less.

 
SUMMARY OF PROVISIONS:

Section 1. Limits the provisions of this act to Nassau and Suffolk Coun-

ties.

Section 2. In the case of nitrogen reducing sewage disposal systems
including associated leaching structures, which are pre-engineered and
pre-manufactured and have been approved for use by the county department
of health, nothing shall prohibit a land surveyor or engineer from
stamping with their seal the plans for the location of such systems on
residential lots for an application to the county department of health.
This section shall only apply to plans for the upgrade of existing
sewage disposal systems and cesspools where design flow is one thousand
gallons or less.

Section 3. Severability Clause

Section 4. Provides for an immediate effective date.

 
JUSTIFICATION:

In Nassau and Suffolk Counties, delays and increased costs deter proper-
ty owners from moving forward with upgrading aging septic systems
despite the availability of grant opportunities. To ensure that the
services associated with upgrading sewage disposal systems and cesspools
are affordable and that companies are available to complete installa-
tions without significant project delays, this legislation provides that
in the case of nitrogen reducing sewage disposal systems including asso-
ciated leaching structures, which are pre-engineered and pre-manufac-
tured and have been approved for use by the county department of health,
a land surveyor or engineer can stamp with their seal the plans for the
location of such systems on residential lots for an application to the
Nassau County or Suffolk County Department of Health. This measure shall
only apply to plans for the upgrade of existing sewage disposal systems
and cesspools where design flow is one thousand gallons or less.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Notwithstanding any provision of article 145 of the educa-
 tion law, the public health law, or any other law to the contrary,  this
 act  shall  apply  to  a county with a population of one million or more
 which draws its primary source of drinking water for a majority of coun-
 ty residents from a designated sole source aquifer.
   § 2. In the case of nitrogen-reducing sewage disposal systems  includ-
 ing associated leaching structures, which are pre-engineered and pre-ma-
 nufactured  and  have  been approved for use by the county department of
 health, nothing shall prohibit a land surveyor or engineer from stamping
 with their seal the plans for the location of such systems  on  residen-
 tial  lots  for an application to the county department of health.  This
 section shall only apply to plans for the  upgrade  of  existing  sewage
 disposal systems and cesspools where design flow is one thousand gallons
 or less.
   §  3.    Severability.  If any clause, sentence, paragraph, section or
 part of this act shall be adjudged by any court of  competent  jurisdic-

 tion to be invalid, such judgment shall not affect, impair or invalidate
 the  remainder  thereof,  but  shall be confined in its operation to the
 clause, sentence, paragraph, section or part thereof, directly  involved
 in the controversy in which such judgment shall have been rendered.
   § 4. This act shall take effect immediately.
