BILL NUMBER: S6403 SPONSOR: SAVINO TITLE OF BILL: An act to amend the insurance law, in relation to insurance coverage of in vitro fertilization and other fertility preser- vation treatments PURPOSE: To remove the exclusion for coverage of in vitro fertilization from the insurance law. SUMMARY OF PROVISIONS: Section one would amend § 3221(k)(C)(iii) of the insurance law to remove an explicit exclusion of in vitro fertilization from the requirements of a group health insurance policy. Section two would amend § 4303(s)(3)(C) of the insurance law to remove an explicit exclusion of in vitro fertilization from the requirements of a nonprofit group health insurance policy

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the insurance law, in relation to insurance coverage of in vitro fertilization and other fertility preservation treatments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Item (iii) of subparagraph (C) of paragraph 6 of subsection (k) of section 3221 of the insurance law, as amended by section 1 of part L of chapter 57 of the laws of 2019, is amended to read as follows: (iii) [Except as provided in items (vi) and (vii) of this subpara- graph, coverage] COVERAGE shall not be required to include the diagnosis and treatment of infertility in connection with: (I) [in vitro fertili- zation, gamete intrafallopian tube transfers or zygote intrafallopian tube transfers; (II)] the reversal of elective sterilizations; [(III)] (II) sex change procedures; [(IV)] (III) cloning; or [(V)] (IV) medical or surgical services or procedures that are deemed to be experimental in accordance with clinical guidelines referenced in item (iv) of this subparagraph. § 2. Subparagraph (C) of paragraph 3 of subsection (s) of section 4303 of the insurance law, as amended by section 2 of part L of chapter 57 of the laws of 2019, is amended to read as follows: (C) [Except as provided in subparagraphs (F) and (G) of this para- graph, coverage] COVERAGE shall not be required to include the diagnosis and treatment of infertility in connection with: (i) [in vitro fertili- zation, gamete intrafallopian tube transfers or zygote intrafallopian tube transfers; (ii)] the reversal of elective sterilizations; [(iii)] (II) sex change procedures; [(iv)] (III) cloning; or [(v)] (IV) medical or surgical services or procedures that are deemed to be experimental in accordance with clinical guidelines referenced in subparagraph (D) of this paragraph. § 3.
