BILL NUMBER: S6440 SPONSOR: SAVINO TITLE OF BILL: An act to amend the administrative code of the city of New York and the vehicle and traffic law, in relation to requiring the city of New York to establish the New York city school safety fund SUMMARY OF PROVISIONS: Section 1. Amends Section 19-904 of the Administrative Code of the City of New York - to establishes the New York city school safety fund. It also dictates the allocation of funds towards school safety initiatives by the chancellor of the city school district of the city of New York. Funds shall not be transferred into the city general fund, unless voted upon by the legislature. Section 2. Amends Section 1174 of the Vehicle and Traffic law by adding a new subdivision (c1). Sets that any fines collected in the City of New York shall be deposited in the NYC School Safety Fund Section 3. Set an immediate effective date.

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the administrative code of the city of New York and the vehicle and traffic law, in relation to requiring the city of New York to establish the New York city school safety fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 19-904 of the administrative code of the city of New York is amended by adding a new subdivision f to read as follows: F. 1. THE CITY SHALL ESTABLISH A FUND TO BE KNOWN AS THE NEW YORK CITY SCHOOL SAFETY FUND. ANY FINES OR MONIES COLLECTED PURSUANT TO SECTION 19-903 OF THIS CHAPTER, EXCEPT FOR ANY MONIES PENDING A PROCEEDING BEFORE OATH, SHALL BE DEPOSITED INTO SUCH FUND. UPON A FINAL DETERMI- NATION OF A PROCEEDING BEFORE OATH, ANY FINES OR MONIES REQUIRED TO BE PAID BY THE LIABLE PARTY SHALL BE DEPOSITED INTO SUCH FUND. 2. MONIES OF THE FUND SHALL BE AVAILABLE TO THE CHANCELLOR OF THE CITY SCHOOL DISTRICT OF THE CITY OF NEW YORK, THE COMMISSIONER OF TRANSPORTA- TION, AND THE POLICE COMMISSIONER TO FUND SCHOOL INITIATIVES RELATING TO THE SAFE TRAVEL OF STUDENTS, INCLUDING BUT NOT LIMITED TO, FUNDING CROSSING GUARDS, MAINTAINING CROSSWALKS, ADDING AND MAINTAINING SIDE- WALKS, INSTALLING STOP SIGNS, AND UPGRADING INFRASTRUCTURE AROUND SCHOOL PROPERTY. 3. MONIES OF THE FUND SHALL NOT BE TRANSFERRED INTO THE GENERAL FUND OF THE CITY. SUCH MONIES SHALL ONLY BE BORROWED FOR OTHER PURPOSES RELATING TO THE CITY ONLY UPON APPROVAL FROM THE STATE LEGISLATURE. § 2. Section 1174 of vehicle and traffic law is amended by adding a new subdivision (c-1) to read as follows: (C-1) NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, ANY FINES OR MONIES COLLECTED IN CITIES HAVING A POPULATION OF ONE MILLION OR MORE PURSUANT TO SUBDIVISION (C) OF THIS SECTION SHALL BE DEPOSITED INTO THE NEW YORK CITY SCHOOL SAFETY FUND ESTABLISHED PURSUANT TO SUBDI- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
