BILL NUMBER: S6505 SPONSOR: MARTINEZ TITLE OF BILL: An act to amend the public health law, in relation to establishing a cap on the price of prescription insulin PURPOSE OR GENERAL IDEA OF BILL: Enacting policies to reduce the costs for New Yorkers with diabetes to obtain life-saving and life-sustaining insulin SUMMARY OF PROVISIONS: Section 1 amends the public health law by adding a new section 280-d to define the meaning of "prescription insulin drug," capping the total cost a covered person under any health insurance carrier that provides coverage for prescription insulin drugs at an amount of one hundred dollars per thirty day supply of insulin, regardless of the amount or type of insulin needed to fill such covered person's prescription. Section 2 sets the effective date.

MARTINEZ, GAUGHRAN -- read twice and ordered print- ed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to establishing a cap on the price of prescription insulin THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 280-d to read as follows: § 280-D. PRESCRIPTION INSULIN PRICE CAP. 1. FOR PURPOSES OF THIS SECTION, "PRESCRIPTION INSULIN DRUG" SHALL MEAN A PRESCRIPTION DRUG CONTAINING INSULIN TO BE USED IN THE TREATMENT OF DIABETES AND THAT: (A) IS REQUIRED BY ANY APPLICABLE FEDERAL OR STATE LAW TO BE DISPENSED ONLY PURSUANT TO A PRESCRIPTION; OR (B) IS RESTRICTED BY ANY APPLICABLE FEDERAL OR STATE LAW TO USE BY PRACTITIONERS ONLY. 2. ANY HEALTH INSURANCE CARRIER THAT PROVIDES COVERAGE FOR PRESCRIPTION INSULIN DRUGS PURSUANT TO THE TERMS OF A HEALTH INSURANCE POLICY OR HEALTH BENEFITS PLAN SHALL CAP THE TOTAL COST A COVERED PERSON IS REQUIRED TO PAY FOR A COVERED PRESCRIPTION INSULIN DRUG AT AN AMOUNT NOT TO EXCEED ONE HUNDRED DOLLARS PER THIRTY DAY SUPPLY OF INSULIN, REGARDLESS OF THE AMOUNT OR TYPE OF INSULIN NEEDED TO FILL SUCH COVERED PERSON'S PRESCRIPTION. 3. NOTHING IN THIS SECTION SHALL PREVENT A HEALTH INSURANCE CARRIER FROM REDUCING A COVERED PERSON'S COST FOR INSULIN BY AN AMOUNT GREATER THAN THE AMOUNT SPECIFIED IN SUBDIVISION TWO OF THIS SECTION. § 2.
