TITLE OF BILL:

An act to amend the education law, in relation to standardizing the
tuition assistance award schedules for independent students at degree-
granting colleges in the state

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends subitem (a) of item 2 of clause (A) of subparagraph (i)
of paragraph a of subdivision 3 of section 667 of the education law, as
amended by section 2 of Part H of chapter 58 of the laws of 2011.

Section 2 amends subitem (c) of item 2 of clause (A) of subparagraph (i)
of paragraph a of subdivision 3 of section 667 of the education law, as
amended by section 2 of part H of chapter 58 of the laws of 2011.

Section 3 provides for the effective date.

JUSTIFICATION:

This legislation standardizes the current award schedules for the
tuition assistance program (TAP) award for independent students.
Currently, all students that had previously received a TAP award prior
to the 1994-1995 academic year if they returned to their undergraduate
studies would be limited to the maximum TAP award based on the TAP sche-
dule in effect when they began their undergraduate career. This legis-
lation will decouple their TAP award from the TAP schedule in effect
when they began their undergraduate career by making all prior awards
eligible to receive up to the current maximum TAP award of $3,025 for
independent students. Following the enactment of this legislation,
students will be able to receive the maximum TAP award under current
law, which would allow these students to also benefit if the current
maximum TAP award was to ever be increased.

 AN ACT to amend the education law,  in  relation  to  standardizing  the
   tuition   assistance  award  schedules  for  independent  students  at
   degree-granting colleges in the state
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subitem (b) of item 2 of clause (A) of subparagraph (i) of
 paragraph a of subdivision 3 of section 667 of  the  education  law,  as
 amended  by  section  2  of part H of chapter 58 of the laws of 2011, is
 amended to read as follows:
   (b) For students first receiving aid in nineteen hundred  ninety-two--
 nineteen  hundred  ninety-three and nineteen hundred ninety-three--nine-
 teen  hundred  ninety-four,  [two  thousand  five  hundred  seventy-five
 dollars] THE SAME AMOUNT AS IN SUBITEM (A) OF THIS ITEM, or
   §  2. Subitem (c) of item 2 of clause (A) of subparagraph (i) of para-
 graph a of subdivision 3 of section 667 of the education law, as amended
 by section 2 of part H of chapter 58 of the laws of 2011, is amended  to
 read as follows:
   (c)  For students first receiving aid in nineteen hundred ninety-one--
 nineteen hundred ninety-two or earlier, [two thousand four hundred fifty
 dollars] THE SAME AMOUNT AS IN SUBITEM (A) OF THIS ITEM; or
   § 3. This act shall take effect immediately.
