BILL NUMBER: S7700 SPONSOR: KENNEDY TITLE OF BILL: An act to amend the public health law, in relation to adding an acute children's hospital to the term enhanced safety net hospital PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to add certain acute children's hospital to the definition of the term enhanced safety net hospital. SUMMARY OF PROVISIONS: Section one of the bill amends paragraph (a) of subdivision 34 of section 2807-c to add an acute children's hospital licensed by the department primarily for the provision of pediatric and neonatal services for which discrete institutional cost report was filed for the two thousand seventeen calendar year, and which has Medicaid discharges in excess of fifty percent of its total discharges to the definition of

KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to adding an acute children's hospital to the term enhanced safety net hospital THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 34 of section 2807-c of the public health law, as added by section 3 of part K of chapter 57 of the laws of 2018, is amended to read as follows: (a) For the purposes of this subdivision, "enhanced safety net hospi- tal" shall mean a hospital which: (i) in any of the previous three calendar years, has met the following criteria: (A) not less than fifty percent of the patients it treats receive medicaid or are medically uninsured; (B) not less than forty percent of its inpatient discharges are covered by medicaid; (C) twenty-five percent or less of its discharged patients are commer- cially insured; (D) not less than three percent of the patients it provides services to are attributed to the care of uninsured patients; and (E) provides care to uninsured patients in its emergency room, hospi- tal based clinics and community based clinics, including the provision of important community services, such as dental care and prenatal care; (ii) is a public hospital operated by a county, municipality, public benefit corporation or the state university of New York; (iii) IS AN ACUTE CHILDREN'S HOSPITAL LICENSED BY THE DEPARTMENT PRIMARILY FOR THE PROVISION OF PEDIATRIC AND NEONATAL SERVICES FOR WHICH A DISCRETE INSTITUTIONAL COST REPORT WAS FILED FOR THE TWO THOUSAND SEVENTEEN CALENDAR YEAR, AND WHICH HAS MEDICAID DISCHARGES IN EXCESS OF FIFTY PERCENT OF ITS TOTAL DISCHARGES; (IV) is federally designated as a critical access hospital; or [(iv)] (V) is federally designated as a sole community hospital. § 2.
