BILL NUMBER: S7755 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the public housing law, in relation to establishing a public housing construction and preservation fund for the city of New York PURPOSE OR GENERAL IDEA OF BILL: To create an independent entity with exclusive authority to lead construction and rehabilitation efforts necessary for the continued operation of the New York City Housing Authority. SUMMARY OF PROVISIONS: The bill adds a new Title 1-A to Article 13 of the Public Housing Law to: create the New York City Public Housing Construction and Preserva- tion Fund; set forth the governance of such Fund by a board of trustees, which shall not include any member of the board of directors of the New

KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the public housing law, in relation to establishing a public housing construction and preservation fund for the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 13 of the public housing law is amended by adding a new title 1-A to read as follows: TITLE 1-A NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION FUND SECTION 402-F. DEFINITIONS. 402-G. NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVA- TION FUND. 402-H. POWERS AND DUTIES OF THE FUND. § 402-F. DEFINITIONS. AS USED IN THIS TITLE, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS, UNLESS THE CONTEXT CLEARLY REQUIRES OTHER- WISE: 1. "FUND" SHALL MEAN THE NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION FUND. 2. "BOARD" SHALL MEAN THE BOARD OF TRUSTEES OF THE NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION FUND. 3. "PROJECT" SHALL HAVE THE SAME MEANING AS SET FORTH IN SUBDIVISION FOURTEEN OF SECTION THREE OF THIS CHAPTER. § 402-G. NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION FUND. 1. THERE IS HEREBY ESTABLISHED A PUBLIC BENEFIT CORPORATION TO BE KNOWN AS THE "NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION FUND". 2. THE FUND SHALL BE GOVERNED BY, AND ITS POWERS SHALL BE EXERCISED BY, A BOARD OF TRUSTEES. NO MEMBER OF THE BOARD OF DIRECTORS OF THE NEW YORK CITY HOUSING AUTHORITY SHALL BE ONE OF THE APPOINTED MEMBERS OF THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
