BILL NUMBER: S7764 SPONSOR: THOMAS TITLE OF BILL: An act to amend the general business law, in relation to including the promotion and expansion of cricket in the state of New York to the jurisdiction of the state athletic commission PURPOSE: To include cricket in the New York State Athletic Commission (NYSAC). SUMMARY OF PROVISIONS: Sections 1-3 amend subdivision 1 of section 1003 of the general business law to modify the purpose of NYSAC and add cricket as a sport that NYSAC must promote and expand. One member of the commission must have exper- tise in the game of cricket. Section 4 establishes the effective date.

THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to including the promotion and expansion of cricket in the state of New York to the jurisdiction of the state athletic commission THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The article heading of article 41 of the general business law, as added by chapter 32 of the laws of 2016, is amended to read as follows: [COMBATIVE] SPORTS § 2. Subdivision 1 of section 1003 of the general business law, as added by chapter 32 of the laws of 2016, is amended to read as follows: 1. The state athletic commission, as named by chapter nine hundred twelve of the laws of nineteen hundred twenty, as amended by chapter six hundred three of the laws of nineteen hundred eighty-one, is continued as a division of the department of state. The commission shall act in the best interests of combative sports AND PROMOTE CERTAIN ADDITIONAL SPORTS IN THE STATE. The commission is enacted: (A) to protect the health, safety and general welfare of all participants in combative sports and spectators thereof, (B) to preserve the integrity of comba- tive sports through the means of licensing, oversight, enforcement and the authorization of sanctioning entities, [and] (C) to facilitate the development and responsible conduct of combative sports throughout the entire state, AND (D) TO PROMOTE AND EXPAND THE GAME OF CRICKET IN THE STATE OF NEW YORK. The commission shall consist of five members who shall be appointed by the governor by and with the advice and consent of the senate. ONE MEMBER OF THE COMMISSION SHALL HAVE EXPERIENCE AND EXPERTISE IN THE GAME OF CRICKET. The governor shall designate one of the members as chairperson of the commission. The members of the commis- sion shall be appointed for terms of three years. Any vacancy in the membership of the commission caused otherwise than by expiration of term shall be filled only for the balance of the term of the member in whose position the vacancy occurs. THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general business law, in relation to including the promotion and expansion of cricket in the state of New York to the jurisdiction of the state athletic commission THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1004 of the general business law, as added by chap- ter 32 of the laws of 2016, is amended to read as follows: § 1004. Jurisdiction of the commission. 1. The commission shall have and is hereby vested with the sole direction, management, control and jurisdiction over: [1.] (A) all authorized combative sports; [2.] (B) all licenses or permits granted by the commission to any and all persons or entities who participate in authorized combative sports; [3.] (C) all determinations regarding the authorization of amateur and professional sanctioning entities; [4.] (D) all gyms, clubs, training camps and other organizations that maintain training facilities to prepare persons for participation in authorized professional combative sports; [5.] (E) the promotion of professional wrestling exhibitions to the extent provided for in this article; and [6.] (F) all contracts directly related to the conduct of authorized professional combative sports in the state of New York. [7.] (G) All disclosures to the commission shall be deemed confiden- tial. 2. THE COMMISSION SHALL HAVE AND IS HEREBY VESTED WITH JURISDICTION OVER THE PROMOTION AND EXPANSION OF THE GAME OF CRICKET IN THE STATE OF NEW YORK. § 2. This act shall take effect immediately.
