TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to redefining
the term "crosswalk" to include an unmarked portion of the roadway

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill will expand the definition of a crosswalk to include every
intersection, regardless of the presence of markings, curb or sidewalk,
to ensure that drivers yield to pedestrians wherever they are legally
crossing the road.

 
SUMMARY OF PROVISIONS:

Section 1: Amends section 110 of the vehicle traffic law to expand the
definition of a sidewalk to include any connection between the end of
two sidewalks at opposite ends of the street, or in the absence of a
curb or sidewalk, the two connecting ends of the traveled roadway.

Where there is no shoulder, curb or sidewalk, a crosswalk is a line, six
feet in width that would that would be included within the prolongation
of the lateral lines of a roadway if a sidewalk did exist.

 
JUSTIFICATION:

New York is one of five states that accounts for over forty-three
percent of all pedestrian deaths in the United States.  Among the fifty
states, New York has the highest death toll of pedestrians killed at
intersections. Expanding the definition of a sidewalk to include every
intersection where a pedestrian can legally cross the road will force
drivers to take greater caution when approaching an intersection. New
York will join states such as Oregon, Washington, South Dakota and Geor-
gia to expand the definition of a crosswalk and ensure that drivers
yield to pedestrians as they approach an intersection. This is a proven
measure to increase driver awareness and caution that studies have shown
lead to reduced death and injury to pedestrians. Adopting this simple,
common-sense measure will help reduce pedestrian death and injury,
whether it be at unmarked intersections in New York's large cities, or
on unmarked rural roads.

 AN  ACT  to amend the vehicle and traffic law, in relation to redefining
   the term "crosswalk" to include an unmarked portion of the roadway
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Section  110 of the vehicle and traffic law is amended by
 adding a new subdivision (c) to read as follows:
   (C) WHERE NO MARKED CROSSWALK EXISTS, A CROSSWALK IS THAT  PORTION  OF
 THE ROADWAY DESCRIBED IN THE FOLLOWING:
   1.  WHERE  A  SIDEWALK,  SHOULDER  OR  A COMBINATION THEREOF EXISTS, A
 CROSSWALK IS THE PORTION OF A ROADWAY AT AN INTERSECTION, NOT MORE  THAN
 TWENTY  FEET  IN  WIDTH AS MEASURED FROM THE PROLONGATION OF THE LATERAL
 LINE OF A ROADWAY TOWARD THE PROLONGATION OF THE ADJACENT PROPERTY LINE,
 THAT IS INCLUDED WITHIN:
   A. THE CONNECTION OF THE LATERAL LINES OF THE SIDEWALKS, SHOULDERS  OR
 A  COMBINATION  THEREOF ON OPPOSITE SIDES OF THE STREET OR HIGHWAY MEAS-
 URED FROM THE CURBS, OR IN THE ABSENCE OF CURBS, FROM THE EDGES  OF  THE
 TRAVELED ROADWAY; OR
   B.  THE  PROLONGATION  OF THE LATERAL LINES OF A SIDEWALK, SHOULDER OR
 BOTH, TO THE SIDEWALK OR SHOULDER ON THE OPPOSITE SIDE OF THE STREET, IF
 THE PROLONGATION WOULD MEET SUCH SIDEWALK OR SHOULDER.
   2. IF THERE IS NEITHER A SIDEWALK OR A SHOULDER, A  CROSSWALK  IS  THE
 PORTION  OF  THE  ROADWAY AT AN INTERSECTION MEASURING NOT LESS THAN SIX
 FEET IN WIDTH THAT WOULD BE INCLUDED  WITHIN  THE  PROLONGATION  OF  THE
 LATERAL  LINES OF THE SIDEWALK, SHOULDER OR BOTH ON THE OPPOSITE SIDE OF
 THE STREET OR HIGHWAY IF THERE WERE A SIDEWALK.
   § 2. This act shall take effect immediately.
