TITLE OF BILL:

An act to amend the public housing law, in relation to establishing an
obligation to affirmatively further fair housing

 
PURPOSE:  To require all state agencies administering housing programs
or enforcing housing laws and all localities administering housing
programs and receiving funds from the state for such activities to
affirmatively further fair housing.   
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 defines covered housing agency.

Section 2 creates an affirmative obligation to further fair housing for
all covered housing agencies.

Section 3 requires covered housing agencies take meaningful steps that
include but are not limited to: identifying and overcoming patterns of
segregation, eradicating racially or ethnically concentrated areas of

poverty, reducing disparities in access to opportunity, addressing
disproportionate housing needs, and encouraging and maintaining compli-
ance with New York's fair housing law.

Section 4 requires the Commissioner annually report the significant
steps undertaken in furtherance of this obligation.

Section 5 sets the effective date.   
JUSTIFICATION:

Housing discrimination has historically pervaded state agencies and
towns, cities, and villages across New York and across the country.
Communities are still reeling from the devastating effects of decades-
long discriminatory practices including redlining and disinvestment in
communities.

By creating an obligation to affirmatively further fair housing for all
state agencies and localities administering housing-related programs and
laws, we will ensure not only that New York will no longer participate
in harmful, discriminatory practices but that the state will actively
seek to create more diverse, inclusive communities. The state and local-
ities will work to overcome historic patterns of segregation, achieve
truly balanced and integrated living patterns, promote fair housing
choice, and foster neighborhoods that are free from discrimination. Fair
housing advances economic opportunity and helps close the wealth gap
that has disadvantaged communities of color for generations. Homeowner-
ship is the biggest source of wealth-building, and a family's neighbor-
hood can determine access to jobs, schools, and a healthy environment.

 AN  ACT  to amend the public housing law, in relation to establishing an

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The public housing law is amended by adding a new article
 14 to read as follows:
                                 ARTICLE XIV
             OBLIGATION TO AFFIRMATIVELY FURTHER FAIR HOUSING
 SECTION 600. OBLIGATION TO AFFIRMATIVELY FURTHER FAIR HOUSING.
   § 600. OBLIGATION TO AFFIRMATIVELY FURTHER FAIR HOUSING. 1.   FOR  THE
 PURPOSES  OF  THIS SECTION, THE TERM "COVERED HOUSING AGENCY" SHALL MEAN
 ANY STATE DEPARTMENT, AGENCY OR OFFICE  ADMINISTERING  HOUSING  LAWS  OR
 HOUSING  PROGRAMS  INCLUDING BUT NOT LIMITED TO NEW YORK STATE HOMES AND
 COMMUNITY RENEWAL, THE DIVISION OF HOUSING AND  COMMUNITY  RENEWAL,  THE
 NEW  YORK  STATE  HOUSING  FINANCE AGENCY, THE AFFORDABLE HOUSING CORPO-
 RATION, THE HOUSING TRUST FUND  CORPORATION,  THE  MUNICIPAL  BOND  BANK
 AGENCY,  THE  STATE  OF  NEW YORK MORTGAGE AGENCY, ANY SUBSIDIARY OF THE
 FOREGOING AGENCIES, AND ANY LOCALITIES RECEIVING FUNDS  FROM  ANY  STATE
 DEPARTMENT,  AGENCY  OR  OFFICE  TO  ADMINISTER  PROGRAMS  OR ACTIVITIES
 RELATED TO HOUSING.
   2. THE COMMISSIONER AND ALL COVERED HOUSING AGENCIES SHALL  ADMINISTER
 ALL  SUCH  PROGRAMS  AND  ACTIVITIES RELATED TO HOUSING IN A MANNER THAT
 AFFIRMATIVELY FURTHERS FAIR HOUSING AND SHALL COOPERATE WITH THE COMMIS-
 SIONER TO FURTHER SUCH PURPOSE.
   3. THE COMMISSIONER AND ALL COVERED HOUSING AGENCIES SHALL TAKE  MEAN-
 INGFUL ACTIONS TO:
   (A) IDENTIFY AND OVERCOME PATTERNS OF SEGREGATION;
   (B) ERADICATE RACIALLY OR ETHNICALLY CONCENTRATED AREAS OF POVERTY;
   (C) REDUCE DISPARITIES IN ACCESS TO OPPORTUNITY;
   (D) ELIMINATE DISPROPORTIONATE HOUSING NEEDS; AND
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

   (E)  ENCOURAGE  AND MAINTAIN COMPLIANCE WITH SECTION TWO HUNDRED NINE-
 TY-SIX OF THE EXECUTIVE LAW.
   4.  THE  COMMISSIONER  AND  ALL COVERED HOUSING AGENCIES SHALL TAKE NO
 ACTION THAT IS MATERIALLY  INCONSISTENT  WITH  THE  OBLIGATION  OF  THIS
 SECTION.
   5. THE COMMISSIONER SHALL ON OR BEFORE NOVEMBER THIRTIETH OF EACH YEAR
 SUBMIT  A  REPORT  TO THE GOVERNOR, THE SPEAKER OF THE ASSEMBLY, AND THE
 TEMPORARY PRESIDENT OF THE SENATE REGARDING THE IMPLEMENTATION  OF  THIS
 SECTION DURING THE PRECEDING FISCAL YEAR. SUCH REPORT SHALL ALSO BE MADE
 AVAILABLE TO THE PUBLIC. THE REPORT SHALL INCLUDE ANY SIGNIFICANT INITI-
 ATIVES,  POLICIES, OR PROGRAMS UNDERTAKEN IN FURTHERANCE OF FAIR HOUSING
 AND ANY RECOMMENDATIONS FOR IMPROVING THE STATE OF FAIR HOUSING  IN  NEW
 YORK.
   § 2. This act shall take effect immediately.

PURPOSE:

to take no actions materially inconsistent with this obligation.

Subsection 5 requires the Commissioner annually report the significant
steps undertaken in furtherance of this obligation.

   5.  THE COMMISSIONER SHALL ON OR BEFORE OCTOBER THIRTIETH OF EACH YEAR
 PRODUCE A DRAFT REPORT THAT SHALL BE MADE AVAILABLE TO THE PUBLIC.   THE
 REPORT  SHALL INCLUDE ANY SIGNIFICANT INITIATIVES, POLICIES, OR PROGRAMS
 UNDERTAKEN IN FURTHERANCE OF FAIR HOUSING AND  ANY  RECOMMENDATIONS  FOR
 IMPROVING THE STATE OF FAIR HOUSING IN NEW YORK.  THE DRAFT REPORT SHALL
 BE  OPEN TO A MINIMUM OF THIRTY DAYS OF PUBLIC COMMENT. THE COMMISSIONER
 SHALL, ON OR BEFORE DECEMBER  FIRST  OF  EACH  YEAR,  SUBMIT  THE  FINAL
 VERSION OF SAID REPORT TO THE GOVERNOR, THE SPEAKER OF THE ASSEMBLY, AND
 THE  TEMPORARY  PRESIDENT  OF THE SENATE.  THE COMMISSIONER SHALL SUBMIT
 ALONG WITH THE FINAL REPORT,  ALL  COMMENTS  RECEIVED  PURSUANT  TO  THE
 PUBLIC COMMENT PERIOD.
   § 2. This act shall take effect immediately.
