BILL NUMBER: S8655 SPONSOR: GAUGHRAN TITLE OF BILL: An act to repeal subdivision 9 of section 511 of the labor law, relating to defining a day student for employment purposes PURPOSE OR GENERAL IDEA OF BILL: To remove the prohibition against an otherwise eligible high school student from receiving unemployment benefits but for the mere fact that they are a high school student. SUMMARY OF PROVISIONS: Section 1. Amends Labor Law Section 511 by repealing subdivision 9. Section 2. Provides that this act shall take effect immediately.

Subdivision 9 of section 511 of the labor law, as amended by chapter 1091 of the laws of 1969, is amended to read as follows: 9. Day student. The term "employment" does not include service SOLELY PERFORMED during [all or any part of the school year or] regular vaca- tion periods [as a part-time worker of] BY any person actually in regu- lar attendance [during the day time] as a student in an elementary or secondary school. § 2.
