BILL NUMBER: S9027 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the public health law, in relation to infection control planning in residential health care facilities PURPOSE: To require residential health care facilities, as part of their pandemic emergency plan, to establish and implement a plan or procedure designat- ing a separate cohort area during an infectious disease outbreak in the residential health care facility. SUMMARY OF PROVISIONS: Section 1: Amends section 2803 of the public health law to add a new subdivision 13, directing the commissioner to require residential health care facilities, as part of their pandemic emergency plan, to establish and implement a plan or procedure designating a separate cohort area

SKOUFIS, RIVERA, MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to infection control planning in residential health care facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2803 of the public health law is amended by adding a new subdivision 13 to read as follows: 13. (A) THE COMMISSIONER SHALL REQUIRE RESIDENTIAL HEALTH CARE FACILI- TIES, AS PART OF THEIR PANDEMIC EMERGENCY PLAN, ESTABLISH AND IMPLEMENT A PLAN OR PROCEDURE DESIGNATING A SEPARATE COHORT AREA DURING AN INFEC- TIOUS DISEASE OUTBREAK IN THE RESIDENTIAL HEALTH CARE FACILITY INCLUDING MINIMUM STANDARDS FOR RESIDENTIAL HEALTH CARE FACILITIES INFECTION CONTROL COHORTING POLICIES AND/OR PROCEDURES AND SHALL INSPECT AND EVAL- UATE ALL RESIDENTIAL HEALTH CARE FACILITIES COHORT AREA POLICIES OR PROCEDURES. (B) IF A RESIDENTIAL HEALTH CARE FACILITY IS UNABLE TO MEET THE MINI- MUM STANDARDS ESTABLISHED BY THE COMMISSIONER UNDER THIS SUBDIVISION, THE FACILITY MAY REQUEST APPROVAL FOR THE WAIVER OF THIS REQUIREMENT. IF A FACILITY IS INCAPABLE OF ESTABLISHING SUCH COHORTING POLICIES AND/OR PROCEDURES, THE COMMISSIONER MAY APPROVE A WAIVER OF A DESIGNATED COHORTING AREA AT A FACILITY. (C) IF A RESIDENTIAL HEALTH CARE FACILITY'S COHORTING POLICY OR PROCE- DURE IS NOT APPROVED BY THE COMMISSIONER, AND THE COMMISSIONER DOES NOT APPROVE A WAIVER, THE RESIDENTIAL HEALTH CARE FACILITY SHALL BE SUBJECT TO PENALTIES DETERMINED BY THE COMMISSIONER. THE COMMISSIONER SHALL ESTABLISH PENALTIES FOR FACILITIES THAT VIOLATE THE REQUIREMENTS OF THIS SUBDIVISION WHICH SHALL INCLUDE, BUT ARE NOT LIMITED TO, LICENSE AND/OR STATE REIMBURSEMENTS CONTINGENT ON A SUBMITTED AND APPROVED PLAN OR AN APPROVED WAIVER. § 2. BILL NUMBER: S9027A SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the public health law, in relation to requiring infection updates and infection control planning in residential health care facilities PURPOSE: To require residential health care facilities, as part of their pandemic emergency plan, to establish and implement a plan or procedure designat- ing a cohort area during an infectious disease outbreak in the residen- tial health care facility and to require residential health care facili- ties to update resident and designated contacts within twelve hours of the detection of the presence of an infection by a resident or staff member. Subparagraph (i) of paragraph (a) of subdivision 12 of section 2803 of the public health law is amended by adding a new clause (C) to read as follows: (C) TO UPDATE ALL RESIDENTS, AUTHORIZED FAMILY MEMBERS, AND GUARDIANS OF RESIDENTS AT THE FACILITY WITHIN TWELVE HOURS OF THE DETECTION OF THE PRESENCE OF AN INFECTION BY A RESIDENT OR STAFF MEMBER BY ELECTRONIC MEANS OR SUCH OTHER MEANS AS MAY BE SELECTED BY EACH RESIDENT, AUTHOR- IZED FAMILY MEMBER, OR GUARDIAN. § 2. Subparagraph (ii) of paragraph (a) of subdivision 12 of section 2803 of the public health law is amended by adding a new clause (C) to read as follows: (C) A PLAN OR PROCEDURE DESIGNATING A SEPARATE COHORT AREA DURING AN INFECTIOUS DISEASE OUTBREAK IN THE RESIDENTIAL HEALTH CARE FACILITY FOR THE SEPARATION OF RESIDENTS THAT ARE SUSPECTED OF BEING INFECTIOUS, INCLUDING THE CREATION OF A DESIGNATED INFECTIOUS DISEASE CARE UNIT. § 3.
