2019-S9097 - Summary
Authorizes the county of Genesee to make voluntary revenue distribution payments to towns or villages located within the county; provides that revenue distributions provided to villages wholly or partially within a town shall be first applied to part-town activities in the area of the town outside of such village, and any remaining balance shall be applied to town wide activities.

BILL NUMBER: S9097 SPONSOR: RANZENHOFER TITLE OF BILL: An act authorizing the county of Genesee to make voluntary revenue distribution payments to towns or villages within the county PURPOSE: This bill relates to how towns and villages in Genesee County may expend voluntary revenue distribution payments from Genesee County. JUSTIFICATION: In 2018, Genesee County notified the towns and villages within the coun- ty that the sales and tax agreements in effect would expire effective 12/31/19. A new long term agreement was entered into between the county and the city of Batavia to provide dependable financial support for the construction of a new county jail and water infrastructure, but it was determined that it would not be prudent to also provide such a long term

RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT authorizing the county of Genesee to make voluntary revenue distribution payments to towns or villages within the county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, the county of Genesee is authorized and enabled to make voluntary revenue distribution payments to towns or villages within the county by local law, ordinance or resolution. If the county of Genesee chooses to make a voluntary revenue distribution payment to a town or village within the county, if a village wholly or partially within a town has received a voluntary revenue distribution from the county, the amount distributed to the town in which such village is wholly or partially situated shall be applied to part-town activities in the area of the town outside of such village. § 2. This act shall take effect January 1, 2021. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD17613-01-0
