TITLE OF BILL:

An act to require the office for the prevention of domestic violence to
conduct a study on domestic violence in the transgender community

 
PURPOSE OF BILL:

To establish a study by the office for the prevention of domestic
violence. SUMMARY OF PROVISIONS:  The office for the prevention of
domestic violence shall conduct a study on domestic violence in the
transgender community with a focus on domestic violence against Black
transgender women. The study shall examine, evaluate, and make recommen-
dations concerning the prevention of domestic violence on the transgen-
der community; find ways to reduce such domestic violence and increase
the reporting of domestic violence; and examine reasons such domestic
violence disproportionately affects Black transgender women. Within one
year after the effective date of this act, the office for the prevention
of domestic violence shall prepare and submit to the governor, stated
senate and assembly chairs, a report containing the study's findings,

including recommendations for legislation or other actions to address
domestic violence in the transgender community.

 
JUSTIFICATION:

Transgender individuals and communities experience sexual violence and
assault, discrimination, domestic abuse, harassment, and hate crimes.
According to the National Resource Center on Domestic Violence, communi-
ties of color experience these events at higher rates. No one should
live in fear or harm and by establishing a study to help understand how
and why these events take place will ultimately assist in providing much
needed protections and safe guards.

   printed to be committed to the Committee on Rules
 
 AN ACT to require the office for the prevention of domestic violence  to
   conduct a study on domestic violence in the transgender community
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The office for the prevention of  domestic  violence  shall
 conduct a study on domestic violence in the transgender community with a
 focus on domestic violence against Black transgender women. The study on
 domestic violence in the transgender community shall:
   (a)  examine,  evaluate and make recommendations concerning the preva-
 lence, causes, effects, risks and costs of such domestic violence on the
 transgender community;
   (b) find ways to  reduce  such  domestic  violence  and  increase  the
 reporting of domestic violence; and
   (c)  examine  reasons  why  such  domestic violence disproportionately
 affects Black transgender women.
   § 2. Within one year after the effective date of this act, the  office
 for  the prevention of domestic violence shall prepare and submit to the
 governor, the temporary president of the  senate,  the  speaker  of  the
 assembly,  the  minority leader of the senate and the minority leader of
 the assembly a report containing the study's findings. Such report shall
 also include any recommendations for legislative or other  actions  that
 can be undertaken to address domestic violence in the transgender commu-
 nity.
   § 3. This act shall take effect immediately.
