 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   prohibiting certain uses of trichloroethylene
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 37-0115 to read as follows:
 § 37-0115. PROHIBITION AGAINST CERTAIN USES OF TRICHLOROETHYLENE.
   1. BEGINNING JANUARY 1, 2021, NO PERSON SHALL USE TRICHLOROETHYLENE AS
 A  VAPOR DEGREASER, AN INTERMEDIATE CHEMICAL TO PRODUCE OTHER CHEMICALS,
 A REFRIGERANT, OR AN EXTRACTION SOLVENT OR IN ANY OTHER MANUFACTURING OR
 CLEANING PROCESS OR USE.
   2. ANY PERSON REQUIRED TO  COMPLY  WITH  THIS  SECTION  SHALL  REPLACE
 TRICHLOROETHYLENE WITH A CHEMICAL DEMONSTRATED TO BE LESS TOXIC TO HUMAN
 HEALTH AND APPROVED BY THE COMMISSIONER.
   3. FOR PURPOSES OF THIS SECTION:
   (A)  "EXTRACTION  SOLVENT" MEANS A SOLVENT USED TO SEPARATE A SPECIFIC
 SUBSTANCE FROM A MIXTURE.
   (B) "PERSON" MEANS ANY  INDIVIDUAL,  FIRM,  ASSOCIATION,  PARTNERSHIP,
 CORPORATION, ORGANIZATION, OR JOINT VENTURE.
   (C) "REFRIGERANT" MEANS A CHEMICAL THAT IS USED AS A HEAT CARRIER IN A
 COOLING  MECHANISM AND THAT CHANGES FROM LIQUID TO GAS AND BACK AGAIN IN
 THE REFRIGERATION CYCLE.
   (D) "TRICHLOROETHYLENE" MEANS A CHEMICAL WITH  THE  CHEMICAL  REGISTRY
 ABSTRACT SERVICES NUMBER OF 79-01-6.
   (E)  "VAPOR  DEGREASER"  MEANS  A  SUBSTANCE  BOILED  TO  A VAPOR THAT
 CONDENSES ONTO METAL PARTS,  CAUSING  BEADING  AND  DRIPPING,  AND  THAT
 REMOVES CONTAMINANTS FROM THE PARTS.
   § 2. This act shall take effect immediately.

 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   prohibiting certain uses of trichloroethylene
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 37-0117 to read as follows:
 § 37-0117. PROHIBITION AGAINST CERTAIN USES OF TRICHLOROETHYLENE.
   1.  BEGINNING  JANUARY FIRST, TWO THOUSAND TWENTY-ONE, NO PERSON SHALL
 USE TRICHLOROETHYLENE AS A VAPOR DEGREASER, AN INTERMEDIATE CHEMICAL  TO
 PRODUCE  OTHER  CHEMICALS, A REFRIGERANT, OR AN EXTRACTION SOLVENT OR IN
 ANY OTHER MANUFACTURING OR CLEANING PROCESS OR USE;  PROVIDED,  HOWEVER,
 THAT DRY CLEANING ESTABLISHMENTS SHALL BE PERMITTED TO USE UP TO, BUT NO
 MORE  THAN,  ONE GALLON OF TRICHLOROETHYLENE PER CALENDAR YEAR; PROVIDED
 FURTHER, HOWEVER, THAT THE OWNER OR OPERATOR OF A  DRY  CLEANING  ESTAB-
 LISHMENT  SHALL  PROHIBIT PERSONS OF CHILDBEARING AGE FROM BEING PRESENT
 IN A ROOM IN WHICH TRICHLOROETHYLENE IS BEING USED FOR THE  DURATION  OF
 THE USE OF THE TRICHOLOROETHYLENE.
   2.  ANY  PERSON  REQUIRED  TO  COMPLY  WITH THIS SECTION SHALL REPLACE
 TRICHLOROETHYLENE WITH A CHEMICAL DEMONSTRATED TO BE LESS TOXIC TO HUMAN
 HEALTH AND APPROVED BY THE COMMISSIONER.
