TITLE OF BILL:

An act to amend the public health law, in relation to grants for nursing
homes and adult care facilities to hire additional employees during the
COVID-19 pandemic; and providing for the repeal of such provisions upon
expiration thereof

 
PURPOSE:

To ensure nursing homes and adult care facilities have the necessary
staff to care for residents during the COVID-19 pandemic, while helping
those who have lost employment due to the pandemic acquire gainful
employment.

 
SUMMARY OF PROVISIONS:

Section 1: Creates a new section 2807-ii of the Public Health Law to
provide for grants to nursing homes and adult care facilities that hire

individuals displaced from their place of employment due to any execu-
tive order issued by the governor related to the COVID-19 pandemic.
Provides that grants shall cover eligible costs associated with hiring
such individuals, including but not limited to administrative costs
associated with recruiting, training, certification and orientation, as
well as grants to cover all such costs in addition to salary costs for
individuals who are hired specifically to staff phone lines during the
pandemic that are dedicated to providing information to family members
of residents of such facilities.

Provides that grants be distributed among nursing homes and adult care
facilities in urban, suburban and rural areas of the state, reflective
of the needs of each area due to the pandemic, and that grants shall not
exceed $3,000 for each displaced employee hired by the facility, except
in cases where the employee was hired to staff information phone lines
during the pandemic, in which case the commissioner may establish limits
on grants . Also requires the Commissioner of the Department of Health
to submit a report to the governor and the legislature indicating the
recipient and amount of each award by September 1, 2021.

Section 2: Provides the effective date.

 
JUSTIFICATION:

The United States recently suffered the worst four-week job loss total
on record, with 22 million Americans losing their job during the
stretch-nearly 1 in 7 workers. As the state that has been hit by COVID-
19 the hardest, New York has been far from immune from not only the
devastating impacts on public health and mortality due to the pandemic,
but the economic impact as well. Since the beginning of the pandemic's
spread in New York, more than one million individuals have filed unem-
ployment claims in the state.

Simultaneously, nursing homes and adult care facilities continue to
strive to mitigate the risks to residents who are highly vulnerable to
severe complications due to COVID-19 while grappling with staffing shor-
tages that have long challenged the industry.  Many of New Yorkers who
have not filed for unemployment have extensive experience in the hospi-
tality and food service industries, and possess unique skill sets that
could translate effectively in helping long-care facilities meet the
needs of their residents during this trying time.

This legislation would establish a grant program through the Department
of Health to cover the costs associated with hiring individuals who have
lost their job due to any executive order issued by the governor related
to the COVID-19 pandemic, such as costs associated with recruiting,
interviewing, training and certifying such individuals. This bill would
also provide facilities with the option to hire temporary employees to
staff a dedicated phone line to more effectively communicate with resi-
dents' loved ones throughout the crisis by including salary costs for
such employees in the grant program. Not only would this grant program
help ensure nursing homes and adult care facilities have sufficient
staff to provide residents with the care they need, it would help indi-
viduals who have lost their job obtain a steady paycheck during this
crisis and beyond.

FISCAL IMPLICATIONS:

Funds would come from the appropriation for services and expenses
related to the outbreak of coronavirus disease 2019 (COVID-19) pursuant
to Chapter 50 of the Laws of 2020.

 
EFFECTIVE DATE:
This act shall take effect immediately and shall expire and be deemed
repealed October 1, 2021.

 AN ACT to amend the public health law, in relation to grants for nursing
   homes and adult care facilities to hire  additional  employees  during
   the COVID-19 pandemic; and providing for the repeal of such provisions
   upon expiration thereof

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 2807-ii to read as follows:
   §  2807-II.  PANDEMIC DISPLACED EMPLOYEES GRANTS FOR NURSING HOMES AND
 ADULT CARE FACILITIES. 1. (A) NOTWITHSTANDING ANY INCONSISTENT PROVISION
 OF LAW TO THE CONTRARY,  WITHIN  FUNDS  APPROPRIATED  FOR  SERVICES  AND
 EXPENSES  RELATED TO THE OUTBREAK OF CORONAVIRUS DISEASE OF TWO THOUSAND
 NINETEEN (COVID-19) PURSUANT TO CHAPTER FIFTY OF THE LAWS OF  TWO  THOU-
 SAND  TWENTY,  THE  COMMISSIONER SHALL MAKE GRANTS AVAILABLE PURSUANT TO
 THIS SECTION TO NURSING HOMES AND ADULT CARE FACILITIES THAT HAVE  HIRED
 AN  EMPLOYEE  OR  MULTIPLE  EMPLOYEES WHO HAVE BEEN DISPLACED FROM THEIR
 PLACE OF EMPLOYMENT DUE TO ANY EXECUTIVE ORDER ISSUED  BY  THE  GOVERNOR
 RELATED TO THE COVID-19 PANDEMIC.
   (B)  SUCH  GRANTS  SHALL  COVER  ELIGIBLE COSTS ASSOCIATED WITH HIRING
 INDIVIDUALS WHO HAVE BEEN DISPLACED FROM THEIR PLACE OF  EMPLOYMENT  DUE
 TO  ANY  EXECUTIVE  ORDER  ISSUED  BY  THE GOVERNOR RELATED TO COVID-19,
 INCLUDING, BUT NOT LIMITED TO (I) ADMINISTRATIVE COSTS  ASSOCIATED  WITH
 RECRUITING SUCH INDIVIDUALS FOR EMPLOYMENT, AS WELL AS TRAINING, CERTIF-
 ICATION AND ORIENTATION; OR (II) SALARY FOR TEMPORARY EMPLOYMENT OF SUCH
 INDIVIDUALS  TO  STAFF  PHONE  LINES  AT SUCH FACILITIES THAT ARE SOLELY
 DEDICATED TO PROVIDING INFORMATION ON RESIDENTS OF  SUCH  FACILITIES  TO
 FAMILY  MEMBERS OF SUCH RESIDENTS FOR AS LONG AS THE GOVERNOR'S DECLARA-
 TION OF A STATE DISASTER EMERGENCY, PURSUANT TO EXECUTIVE  ORDER  NUMBER
 TWO HUNDRED TWO OF TWO THOUSAND TWENTY REMAINS IN EFFECT.
   (C)  THE  COMMISSIONER MAY PROMULGATE RULES AND REGULATIONS RELATED TO
 DETERMINING ELIGIBLE COSTS ASSOCIATED WITH HIRING INDIVIDUALS  WHO  HAVE
 BEEN DISPLACED FROM THEIR PLACE OF EMPLOYMENT DUE TO ANY EXECUTIVE ORDER

 ISSUED  BY  THE GOVERNOR RELATED TO COVID-19, THE DISTRIBUTION OF GRANTS
 PURSUANT TO THIS SECTION, AND THE RESPONSIBILITIES OF NURSING HOMES  AND
 ADULT CARE FACILITIES THAT HAVE RECEIVED SUCH GRANTS.
   2.  GRANTS SHALL, AS EQUITABLY AS POSSIBLE, BE DISTRIBUTED AMONG NURS-
 ING HOMES AND ADULT CARE FACILITIES IN URBAN, SUBURBAN AND  RURAL  AREAS
 OF  THE  STATE, REFLECTIVE OF THE NEEDS OF EACH AREA DUE TO THE COVID-19
 PANDEMIC.
   3. GRANTS MADE BY THE COMMISSIONER PURSUANT  TO  SUBPARAGRAPH  (I)  OF
 PARAGRAPH  (B) OF SUBDIVISION ONE OF THIS SECTION SHALL NOT EXCEED THREE
 THOUSAND DOLLARS FOR EACH EMPLOYEE HIRED WHO  HAD  BEEN  DISPLACED  FROM
 THEIR  PLACE  OF  EMPLOYMENT  DUE  TO  ANY EXECUTIVE ORDER ISSUED BY THE
 GOVERNOR RELATED TO THE COVID-19 PANDEMIC. THE COMMISSIONER  IS  AUTHOR-
 IZED  TO  ESTABLISH  LIMITS  ON GRANTS MADE FOR EACH EMPLOYEE HIRED BY A
 FACILITY, OR LIMITS ON GRANTS MADE TO EACH FACILITY, PURSUANT TO SUBPAR-
 AGRAPH (II) OF PARAGRAPH (B) OF SUBDIVISION ONE OF THIS SECTION.
   4. THE COMMISSIONER SHALL PREPARE AND SUBMIT A REPORT TO THE  GOVERNOR
 AND THE LEGISLATURE, INCLUDING TO THE TEMPORARY PRESIDENT OF THE SENATE,
 THE  MINORITY  LEADER OF THE SENATE, THE SPEAKER OF THE ASSEMBLY AND THE
 MINORITY LEADER OF THE ASSEMBLY, ON OR BEFORE SEPTEMBER FIRST, TWO THOU-
 SAND TWENTY-ONE, INDICATING GRANT RECIPIENTS  AND  THE  AMOUNT  OF  EACH
 GRANT AWARDED PURSUANT TO THIS SECTION.
   §  2.  This  act shall take effect immediately and shall expire and be
 deemed repealed October 1, 2021.
