S T A T E O F N E W Y O R K ________________________________________________________________________ 10318 I N A S S E M B L Y May 13, 2022 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. K. Brown) -- read once and referred to the Committee on Governmental Operations AN ACT to amend the public buildings law and the parks, recreation and historic preservation law, in relation to requiring all public build- ings and all parks, recreation and historic preservation sites have bins for recyclable and compostable materials THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public buildings law is amended by adding a new section 147 to read as follows: § 147. BINS FOR RECYCLABLE AND COMPOSTABLE MATERIALS. A COVERED PUBLIC BUILDING SHALL ESTABLISH AND IMPLEMENT A PROGRAM FOR THE COLLECTION OF RECYCLABLE AND COMPOSTABLE MATERIALS THAT ARE DISCARDED IN SUCH BUILDING. SUCH RECYCLABLE MATERIALS SHALL INCLUDE, BUT NOT BE LIMITED TO, METAL, PLASTIC, GLASS AND PAPER. SUCH COMPOSTABLE MATERIALS SHALL INCLUDE, BUT NOT BE LIMITED TO, FOOD SCRAPS, TREE AND BRUSH TRIM- MINGS, LEAVES, AND OTHER COMPOSTABLE MATERIALS. IN EACH SUCH BUILDING THERE SHALL BE INSTALLED BINS FOR THE COLLECTION OF RECYCLABLE MATERIALS AND BINS FOR THE COLLECTION OF COMPOSTABLE MATERIALS. SUCH BINS SHALL BE ALONGSIDE ANY UNDESIGNATED WASTE BINS AND ANY BINS FOR NON-RECYCLA- BLE, NON-COMPOSTABLE WASTE. A BIN DESIGNATED FOR RECYCLABLE MATERIALS SHALL BE REGULARLY COLLECTED AND THE RECYCLABLE MATERIALS WITHIN RECY- CLED. A BIN DESIGNATED FOR COMPOSTABLE MATERIALS SHALL BE REGULARLY COLLECTED AND THE CONTENTS WITHIN COMPOSTED. § 2. Subdivision 23 of section 3.09 of the parks, recreation and historic preservation law, as added by chapter 312 of the laws of 2017, is amended to read as follows: 23. Establish and implement a program for the collection of recyclable AND COMPOSTABLE materials that are discarded in state parks, state historic sites and state recreational facilities. Such recyclable mate- rials shall include, but not be limited to, metal, plastic, glass and paper. SUCH COMPOSTABLE MATERIALS SHALL INCLUDE, BUT NOT BE LIMITED TO, FOOD SCRAPS, TREE AND BRUSH TRIMMINGS, LEAVES, AND OTHER COMPOSTABLE MATERIALSD In each such park, historic site and recreational facility EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
