ROSEN- THAL -- read once and referred to the Committee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to the sale, use and application of styrene and products containing styrene by appear- ance enhancement businesses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 404-d to read as follows: § 404-D. STYRENE. 1. NO OWNER OR OPERATOR OF AN APPEARANCE ENHANCEMENT BUSINESS SHALL KNOWINGLY: A. SELL, USE OR APPLY TO ANY PERSON STYRENE OR A PRODUCT CONTAINING STYRENE; OR B. DIRECT ANY AGENT OR EMPLOYEE OF SUCH BUSINESS TO SELL, USE OR APPLY TO ANY PERSON STYRENE OR A PRODUCT CONTAINING STYRENE. 2. A FIRST VIOLATION OF THIS SECTION SHALL BE PUNISHABLE BY A CIVIL PENALTY OF NOT MORE THAN ONE THOUSAND DOLLARS. A SECOND OR ANY SUBSE- QUENT VIOLATION OF THIS SECTION SHALL BE A CLASS B MISDEMEANOR. § 2. This act shall take effect immediately.
