2021-A393 - Summary

Relates to establishing an interagency task force on hate crimes and domestic terrorism; requires an annual report to the governor and leaders of the legislature including data gathered by the task force on the nature, extent, and incidence of hate crimes and domestic terrorism in the state and a summary of any recommendations developed over the year to strengthen state and local prevention efforts and any other information deemed necessary; provides for the repeal of such provisions upon the expiration thereof.

 AN ACT to amend the executive law, in relation to establishing an inter-
   agency task force on hate crimes and domestic terrorism

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The executive law is amended by adding a new section 235 to
 read as follows:
   §  235.  ESTABLISHMENT  OF  INTERAGENCY  TASK FORCE ON HATE CRIMES AND
 DOMESTIC TERRORISM. 1. THERE IS ESTABLISHED AN INTERAGENCY TASK FORCE ON
 HATE CRIMES AND DOMESTIC TERRORISM, WHICH SHALL CONSIST OF THE FOLLOWING
 MEMBERS OR THEIR DESIGNEES: (A) THE SUPERINTENDENT OF STATE POLICE;  (B)
 THE  COMMISSIONER  OF THE DIVISION OF CRIMINAL JUSTICE SERVICES; (C) THE
 COMMISSIONER  OF  THE  DIVISION  OF  HOMELAND  SECURITY  AND   EMERGENCY
 SERVICES;  (D)  THE  DIRECTOR  OF THE OFFICE OF VICTIM SERVICES; (E) THE
 DIRECTOR OF THE DIVISION OF HUMAN RIGHTS; (F) ONE MEMBER, WHO  SHALL  BE
 APPOINTED  BY  THE  GOVERNOR AS A REPRESENTATIVE OF A GROUP OR GROUPS OF
 PEOPLE WHO HAVE BEEN TARGETED BY HATE CRIME ACTS  OR  ACTS  OF  DOMESTIC
 TERRORISM;  (G)  ONE MEMBER, WHO SHALL BE APPOINTED BY THE GOVERNOR AS A
 REPRESENTATIVE OF A GROUP OR GROUPS WHO ADVOCATE FOR OR OTHERWISE REPRE-
 SENT COMMUNITIES WHO HAVE BEEN TARGETED BY HATE CRIME ACTS  OR  ACTS  OF
 DOMESTIC TERRORISM; (H) ONE MEMBER, WHO SHALL BE APPOINTED ON THE RECOM-
 MENDATION  OF THE TEMPORARY PRESIDENT OF THE SENATE; (I) ONE MEMBER, WHO
 SHALL BE APPOINTED ON THE RECOMMENDATION OF THE SPEAKER OF THE ASSEMBLY;
 (J) ONE MEMBER, WHO SHALL BE APPOINTED  ON  THE  RECOMMENDATION  OF  THE
 PRESIDENT  OF THE NEW YORK STATE DISTRICT ATTORNEYS ASSOCIATION; (K) ONE
 MEMBER, WHO SHALL BE APPOINTED ON THE RECOMMENDATION OF THE PRESIDENT OF
 THE NEW YORK STATE ASSOCIATION OF CHIEFS OF POLICE; AND OTHERS AS MAY BE
 NECESSARY TO CARRY  OUT  THE  DUTIES  AND  RESPONSIBILITIES  UNDER  THIS
 SECTION.  THE  TASK  FORCE WILL BE CO-CHAIRED BY THE COMMISSIONER OF THE

 APPOINTED  ON  THE RECOMMENDATION OF THE PRESIDENT OF THE NEW YORK STATE
 ASSOCIATION OF CHIEFS OF POLICE.  THE TASK FORCE WILL BE  CO-CHAIRED  BY
 THE  COMMISSIONER  OF  THE DIVISION OF CRIMINAL JUSTICE SERVICES AND THE
 SUPERINTENDENT OF STATE POLICE, OR THEIR DESIGNEES.  IT  SHALL  MEET  AS
 OFTEN AS IS NECESSARY, BUT NO LESS THAN ONCE PER YEAR, AND UNDER CIRCUM-
 STANCES  AS ARE APPROPRIATE TO FULFILLING ITS DUTIES UNDER THIS SECTION.
