PAULIN, GALEF, MAGNARELLI -- Multi-Sponsored by -- M. of A. COOK -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to continuing medical education for physicians THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 6524 of the education law is amended by adding a new subdivision 12 to read as follows: (12)(A) FOLLOWING HIS OR HER FIRST RE-REGISTRATION PERIOD, NO PHYSI- CIAN MAY BE RE-REGISTERED UNLESS HE OR SHE, AS PART OF THE RE-REGISTRA- TION APPLICATION, INCLUDES AN ATTESTATION MADE UNDER PENALTY OF PERJURY, IN A FORM PRESCRIBED BY THE COMMISSIONER, THAT HE OR SHE HAS COMPLETED AT LEAST FIFTY HOURS OF CONTINUING MEDICAL EDUCATION PURSUANT TO REGU- LATIONS PROMULGATED BY THE COMMISSIONER. (B) CERTIFICATION OR RECERTIFICATION OF THE PHYSICIAN BY A PHYSICIAN SPECIALTY ORGANIZATION MAY BE COMPLETED IN LIEU OF COMPLIANCE WITH THE CONTINUING MEDICAL EDUCATION REQUIREMENTS OF PARAGRAPH (A) OF THIS SUBDIVISION DURING THE CYCLE IN WHICH CERTIFICATION OR RECERTIFICATION IS GRANTED. AS USED IN THIS SECTION, "PHYSICIAN SPECIALTY ORGANIZATION" MEANS: (I) THE AMERICAN BOARD OF MEDICAL SPECIALTIES; (II) THE AMERICAN OSTEOPATHIC ASSOCIATION BUREAU OF PROFESSIONAL EDUCATION; (III) THE AMERICAN BOARD OF PHYSICIAN SPECIALTIES; (IV) THE ROYAL COLLEGE OF PHYSICIANS AND SURGEONS OF CANADA; (V) ANY OTHER ENTITY MAINTAINING STANDARDS FOR AND CERTIFYING PHYSICIAN SPECIALTY CERTIFICATION THAT: (A) IS APPROVED BY THE ACCREDITATION COUNCIL OF GRADUATE MEDICAL EDUCATION OR AN EQUIVALENT COUNCIL, (B) REQUIRES SUCCESSFUL COMPLETION OF A COMPREHENSIVE EXAMINATION TO BE CERTIFIED BY SUCH ENTITY, (C) REQUIRES RECERTIFICATION EVERY TEN YEARS OR LESS, (D) REQUIRES AT LEAST TWENTY- FIVE HOURS CREDIT OF CONTINUING MEDICAL EDUCATION EACH YEAR, AND (E) IS A TAX EXEMPT ORGANIZATION DESCRIBED IN SECTION 501(C) OF THE INTERNAL EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
