MANKTELOW -- read once and referred to the Committee on Labor AN ACT to amend the labor law, in relation to excluding claims for unem- ployment insurance arising as a result of an employer closing his or her business because of novel coronavirus COVID-19, from an employer's experience rating charges THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (e) of subdivision 1 of section 581 of the labor law is amended by adding a new subparagraph 7 to read as follows: (7) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY EMPLOYER WHOSE EMPLOYEES RECEIVE PAYMENTS UNDER THIS ARTICLE AND WHOSE CLAIMS FOR UNEM- PLOYMENT INSURANCE ARISE AS A RESULT OF THE CLOSURE OF AN EMPLOYER FOR ANY REASON RELATED TO NOVEL CORONAVIRUS, COVID-19, OR AS A RESULT OF A MANDATORY ORDER OF A GOVERNMENT ENTITY TO CLOSE SUCH EMPLOYER, SHALL NOT HAVE INCLUDED IN THEIR EXPERIENCE RATING CHARGES THE AMOUNTS SO PAID ON ACCOUNT. § 2.
