 AN  ACT to amend the public health law, in relation to requiring notifi-
   cation and the informed consent of the patient  prior  to  prescribing
   psychiatric drugs

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 3346 to read as follows:
   §  3346.  PSYCHIATRIC DRUG INFORMED CONSENT. NO DOCTOR SHALL PRESCRIBE
 AN ANTIPSYCHOTIC, ANTIDEPRESSANT, HALLUCINOGEN, OR MOOD STABILIZER DRUG,
 BRAND OR GENERIC, AS DEFINED IN SECTION THIRTY-THREE HUNDRED SIX OF THIS
 ARTICLE, FOR THE TREATMENT OF PSYCHIATRIC DISORDERS OR CONDITIONS  WITH-
 OUT  THE  PRIOR  NOTIFICATION  AND  THE  SIGNED  INFORMED CONSENT OF THE
 PATIENT INFORMING THE PATIENT OF ANY POSSIBLE  ADVERSE  EFFECTS  OF  THE
 DRUG AND THE INTERACTION WITH OTHER MEDICATIONS THE PATIENT IS CURRENTLY
 PRESCRIBED.
   § 2. This act shall take effect immediately.
