CRUZ -- read once and referred to the Committee on Governmental Operations AN ACT to amend the legislative law, in relation to authorizing the joint commission on public integrity to provide a training course concerning anti-sexual harassment training for lobbyists and requiring lobbyists to complete the course annually THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1-d of the legislative law is amended by adding a new subdivision (i) to read as follows: (I) PROVIDE AN ONLINE ANTI-SEXUAL HARASSMENT TRAINING COURSE FOR INDI- VIDUALS REGISTERED AS LOBBYISTS PURSUANT TO SECTION ONE-E OF THIS ARTI- CLE. THE CURRICULUM FOR THE COURSE SHALL BE BASED UPON THE MODEL SEXUAL HARASSMENT PREVENTION GUIDANCE DOCUMENT AND SEXUAL HARASSMENT PREVENTION POLICY PROMULGATED BY THE DEPARTMENT OF LABOR PURSUANT TO SECTION TWO HUNDRED ONE-G OF THE LABOR LAW AND SHALL INCLUDE, BUT NOT BE LIMITED TO, EXPLANATIONS AND DISCUSSIONS OF WHAT CONSTITUTES SEXUAL HARASSMENT, THE STATUTES AND REGULATIONS OF NEW YORK CONCERNING SEXUAL HARASSMENT, SUMMARIES OF ADVISORY OPINIONS, UNDERLYING PURPOSES AND PRINCIPLES OF THE RELEVANT LAWS, AND EXAMPLES OF PRACTICAL APPLICATION OF THESE LAWS AND PRINCIPLES. THE COMMISSION SHALL PREPARE THOSE METHODS AND MATERIALS NECESSARY TO IMPLEMENT THE CURRICULUM. THE COMMISSION SHALL PREPARE AND DELIVER TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY AN ANNUAL REPORT ON OR BEFORE DECEMBER THIRTY- FIRST OF EACH YEAR WHICH IDENTIFIES THE NUMBER OF LOBBYISTS WHO, AS OF SEPTEMBER THIRTIETH OF THAT YEAR, HAVE FAILED TO COMPLETE THE TRAINING COURSE AND ARE PROHIBITED FROM APPEARING BEFORE THE LEGISLATURE UNTIL THE DEFECT IS CURED. § 2. Sections 1-u and 1-v of the legislative law, section 1-v as relettered by chapter 1 of the laws of 2005, are renumbered sections 1-x and 1-y and a new section 1-u is added to read as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

THE COMMISSION SHALL PREPARE AND PUBLISH ON ITS WEBSITE A LIST OF THE NAMES OF LOBBYISTS WHO HAVE FAILED TO COMPLETE THE TRAINING COURSE BY THE REQUIRED DATE AND ARE PROHIBITED FROM ENGAGING IN LOBBYING ACTIVITIES, PROVIDED THE COMMISSION SHALL UPDATE THE LIST AND REMOVE THE NAME OF ANY LOBBYIST THAT COMPLETES THE TRAINING COURSE WITH- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
