S T A T E O F N E W Y O R K ________________________________________________________________________ 6048 2021-2022 Regular Sessions I N A S S E M B L Y March 5, 2021 ___________ Introduced by M. of A. LAWLER -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the posting of "no trespassing" signs by public school districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 409-n to read as follows: § 409-N. NO TRESPASSING SIGNS; REGULATIONS. FOR PURPOSES OF PROVIDING FOR THE SAFETY OF ITS STUDENTS AND PERSONNEL, PUBLIC SCHOOL DISTRICTS SHALL ADOPT AND ENFORCE RULES AND REGULATIONS FOR THE CONTROL OF, USE, AND ACCESS TO, SCHOOL GROUNDS AND FACILITIES. SUCH RULES AND REGULATIONS SHALL INCLUDE, BUT ARE NOT LIMITED TO, ERECTING "NO TRESPASSING" SIGNS AT THE ENTRANCE OR ENTRANCES TO ANY SUCH GROUNDS AND ANY OTHER APPROPRI- ATE POINTS THEREIN. FAILURE TO OBEY SUCH SIGNS SHALL RESULT IN A VIOLATION OF SECTION 140.05 OF THE PENAL LAW AND SHALL BE PUNISHABLE APPROPRIATELY. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
