S T A T E O F N E W Y O R K ________________________________________________________________________ 7548 2021-2022 Regular Sessions I N A S S E M B L Y May 13, 2021 ___________ Introduced by M. of A. L. ROSENTHAL -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to disclosure of federal, state or local government funding by respondents in human rights claims; and to amend the general obligations law, in relation to the disclosure of certain information by the state division of human rights notwithstanding nondisclosure agreements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 297 of the executive law is amended by adding a new paragraph f to read as follows: F. PRIOR TO THE HEARING REQUIRED BY PARAGRAPH A OF THIS SUBDIVISION, THE RESPONDENT SHALL NOTIFY THE DIVISION IF THEY ARE A RECIPIENT OF ANY FEDERAL, STATE OR LOCAL GOVERNMENT FUNDING, THE PROVIDER AND PURPOSE OF SUCH FUNDING, AND THE AMOUNT OF SUCH FUNDING. § 2. Section 5-336 of the general obligations law is amended by adding a new subdivision 3 to read as follows: 3. WHEN A SETTLEMENT, AGREEMENT OR OTHER RESOLUTION OF A CLAIM RESULTS FROM A COMPLAINT TO THE STATE DIVISION OF HUMAN RIGHTS UNDER ARTICLE FIFTEEN OF THE EXECUTIVE LAW AND ONE OR MORE PARTIES TO THE SETTLEMENT, AGREEMENT OR OTHER RESOLUTION IS THE RECIPIENT OF FUNDS FROM ANY FEDER- AL, STATE, OR LOCAL AGENCY OR DEPARTMENT AND SUCH INFORMATION HAS BEEN DISCLOSED PURSUANT TO PARAGRAPH F OF SUBDIVISION FOUR OF SECTION TWO HUNDRED NINETY-SEVEN OF THE EXECUTIVE LAW, THE STATE DIVISION OF HUMAN RIGHTS SHALL NOTIFY SUCH FEDERAL, STATE, OR LOCAL AGENCY OR DEPARTMENT OF SUCH AGREEMENT OR RESOLUTION, NOTWITHSTANDING THE PROVISION OF NONDISCLOSURE BETWEEN THE PARTIES. § 3.
