 AN ACT to amend the education law, in relation to  prohibiting  individ-
   uals  serving  on a school or library board of trustees from resigning
   from their current term in order to run for a vacant trustee position

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  2105 of the education law is amended by adding a
 new subdivision 15 to read as follows:
   15. NOTWITHSTANDING ANY OTHER LAW  TO  THE  CONTRARY,  ANY  INDIVIDUAL
 CURRENTLY  SERVING  AS  A  TRUSTEE  OF A COMMON SCHOOL DISTRICT, CENTRAL
 SCHOOL DISTRICT OR UNION-FREE SCHOOL DISTRICT SHALL BE  PROHIBITED  FROM
 RESIGNING  HIS  OR HER CURRENT POSITION AS TRUSTEE IN ORDER TO RUN FOR A
 VACANT TRUSTEE POSITION AND SHALL ONLY BE ELIGIBLE TO RUN FOR  A  VACANT
 TRUSTEE  POSITION  ONCE  HIS OR HER CURRENT TERM HAS EXPIRED. ANY VACANT
 TRUSTEE POSITION SHALL BE FILLED IN ACCORDANCE WITH SECTION TWO THOUSAND
 ONE HUNDRED THIRTEEN OF THIS PART.
   § 2. Section 260 of the education law  is  amended  by  adding  a  new
 subdivision 7-a to read as follows:
   7-A.  ANY  INDIVIDUAL  SERVING  ON  THE  BOARD OF TRUSTEES OF A PUBLIC
 LIBRARY SHALL BE PROHIBITED FROM RESIGNING HIS OR HER  CURRENT  POSITION
 AS  TRUSTEE IN ORDER TO RUN FOR A VACANT TRUSTEE POSITION AND SHALL ONLY
 BE ELIGIBLE TO RUN FOR A VACANT TRUSTEE POSITION ONCE HIS OR HER CURRENT
 TERM HAS EXPIRED.
   § 3. This act shall take effect immediately.
