 AN ACT to amend the public health law, in relation to reporting of  home
   care service usage
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public health law is amended by adding  a  new  section
 3614-f to read as follows:
   § 3614-F. REPORTING OF HOME CARE SERVICE USAGE. 1. FOR THE PURPOSES OF
 THIS SECTION, THE TERM "COMPREHENSIVE HEALTH SERVICES PLAN" SHALL MEAN A
 COMPREHENSIVE  HEALTH SERVICES PLAN OPERATING PURSUANT TO ARTICLE FORTY-
 FOUR OF THIS CHAPTER AND PROVIDING HOME CARE  SERVICES  IN  THE  MEDICAL
 ASSISTANCE PROGRAM.
   2.  ON A QUARTERLY BASIS, THE DEPARTMENT SHALL PUBLISH ON ITS WEBSITE,
 IN A SEARCHABLE AND ACCESSIBLE FORMAT, THE INFORMATION REQUIRED PURSUANT
 TO  SUBDIVISION  THREE  OF  THIS  SECTION.  SUCH  INFORMATION  SHALL  BE
 FURNISHED  TO  THE  COMMISSIONER  BY  PROVIDERS  OF  HOME CARE SERVICES,
 COMPREHENSIVE HEALTH SERVICES PLANS, AND  LOCAL  DEPARTMENTS  OF  SOCIAL
 SERVICES UNDER EXISTING LAWS AND REGULATIONS.
   3.  AT  A  MINIMUM,  THE INFORMATION TO BE PUBLISHED BY THE DEPARTMENT
 PURSUANT TO SUBDIVISION TWO OF THIS SECTION SHALL INCLUDE,  BUT  NOT  BE
 LIMITED TO:
   (A)  THE NUMBER OF INDIVIDUALS RECEIVING HOME CARE SERVICES BY TYPE OF
 HOME CARE SERVICE, LISTED BY BOTH COUNTY AND BY SERVICES  AUTHORIZED  BY
 THE  LOCAL  DEPARTMENT  OF  SOCIAL  SERVICES  AND  COMPREHENSIVE  HEALTH
 SERVICES PLAN;
   (B) THE NUMBER OF INDIVIDUALS RECEIVING HOME CARE SERVICES BY PAYOR;
   (C) THE NUMBER OF INDIVIDUALS WHO HAVE HAD A PERMANENT  TRANSFER  FROM
 HOME CARE SERVICES TO A NURSING HOME OR ASSISTED LIVING FACILITY; AND
   (D)  AGGREGATED INFORMATION ABOUT SERVICE USAGE, INCLUDING THE AVERAGE
 NUMBER OF HOURS AUTHORIZED ACROSS ALL RECIPIENTS OF HOME  CARE  SERVICES
