GOTTFRIED, ANGELINO, BICHOTTE HERMELYN, BRONSON, ENGLEBRIGHT, GALEF, GUNTHER, KELLES, LUNSFORD, SEAWRIGHT, SILLITTI, SIMON, WEPRIN -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to home care work- force mentor support THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3622 of the public health law, as renumbered by section 22 of part C of chapter 58 of the laws of 2004, is renumbered section 3623 and a new section 3622 is added to read as follows: § 3622. GRANTS FOR HOME CARE WORKFORCE MENTOR SUPPORT. 1. THE COMMIS- SIONER SHALL, WITHIN AMOUNTS APPROPRIATED, MAKE GRANTS TO HOME CARE SERVICE AGENCIES AND NOT-FOR-PROFIT ENTITIES FOR PROVIDING MENTOR SUPPORT FOR HOME CARE SERVICE WORKERS (REFERRED TO IN THIS SECTION AS "MENTOR SUPPORT"). GRANT APPLICATIONS SHALL BE IN A MANNER AND FORM PRESCRIBED BY THE COMMISSIONER. MENTOR SUPPORT SHALL USE MENTORS WHO HAVE PRACTICAL EXPERIENCE IN HOME CARE SERVICE COMMENSURATE WITH THE LEVEL OF HOME CARE SERVICE EXPECTED OF THE WORKERS BEING MENTORED. 2. IN AWARDING GRANTS UNDER THIS SECTION, THE COMMISSIONER SHALL TAKE INTO CONSIDERATION, IN RELATION TO THE AREA TO BE SERVED, THE NEED FOR HOME CARE SERVICES AND FOR RECRUITMENT AND RETENTION OF HOME CARE SERVICE WORKERS. IN DEVELOPING THE MENTOR SUPPORT PROGRAM, THE COMMIS- SIONER SHALL CONSULT WITH REPRESENTATIVES OF HOME CARE SERVICE AGENCIES AND LABOR ORGANIZATIONS REPRESENTING HOME CARE SERVICE WORKERS. 3. THE COMMISSIONER SHALL MAKE REGULATIONS TO ADMINISTER THIS SECTION. § 2. This act shall take effect immediately.
