EPSTEIN -- read once and referred to the Commit- tee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to requiring elec- tric vehicle charging stations to be installed at gasoline stations in an amount equal to or greater than the number of new gas dispensing nozzles being installed at such gasoline station THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 396-xx to read as follows: § 396-XX. GASOLINE STATIONS; ELECTRIC VEHICLE CHARGING STATIONS REQUIRED. 1. DEFINITIONS. AS USED IN THIS SECTION: (A) "DEALER" SHALL MEAN ANY PERSON OWNING OR OPERATING A PREMISES OR FACILITY WITH FOUR OR MORE GAS DISPENSING NOZZLES FOR THE RETAIL SALE OF MOTOR FUELS FOR USE IN MOTOR VEHICLES. (B) "ELECTRIC VEHICLE CHARGING STATION" SHALL MEAN A STATION THAT DELIVERS ELECTRICITY FROM A SOURCE OUTSIDE AN ELECTRIC VEHICLE INTO ONE OR MORE ELECTRIC VEHICLES. AN ELECTRIC VEHICLE CHARGING STATION MAY INCLUDE SEVERAL CHARGE POINTS SIMULTANEOUSLY CONNECTING SEVERAL ELECTRIC VEHICLES TO THE STATION AND ANY RELATED EQUIPMENT NEEDED TO FACILITATE CHARGING PLUG-IN ELECTRIC VEHICLES. 2. ANY DEALER INSTALLING NEW GAS DISPENSING NOZZLES FOR THE RETAIL SALE OF MOTOR FUELS FOR USE IN MOTOR VEHICLES SHALL INSTALL ELECTRIC VEHICLE CHARGING STATIONS AT SUCH GASOLINE STATION IN AN AMOUNT EQUAL TO OR GREATER THAN THE NUMBER OF NEW GAS DISPENSING NOZZLES BEING INSTALLED AT SUCH GASOLINE STATION. 3. NO BUILDING PERMIT SHALL BE ISSUED TO A DEALER IF THE DOCUMENTATION SUBMITTED FOR SUCH BUILDING PERMIT DOES NOT REFLECT THE INSTALLATION OF ELECTRIC VEHICLE CHARGING STATIONS IN AN AMOUNT EQUAL TO OR GREATER THAN THE NUMBER OF NEW GAS DISPENSING NOZZLES BEING INSTALLED AT SUCH GASO- LINE STATION. § 2. (C) "ELECTRIC VEHICLE CHARGING STATION" SHALL MEAN A LEVEL TWO CHARG- ING STATION THAT DELIVERS ELECTRICITY FROM A SOURCE OUTSIDE AN ELECTRIC VEHICLE INTO ONE OR MORE ELECTRIC VEHICLES. AN ELECTRIC VEHICLE CHARGING STATION MAY INCLUDE SEVERAL CHARGE POINTS SIMULTANEOUSLY CONNECTING SEVERAL ELECTRIC VEHICLES TO THE STATION AND ANY RELATED EQUIPMENT NEED- ED TO FACILITATE CHARGING PLUG-IN ELECTRIC VEHICLES.
