 AN ACT to amend the executive law, in relation to requiring the  instal-
   lation and periodic inspection of water detector alarms in residential
   dwellings and certain commercial buildings
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 378 of the executive law is amended by  adding  two
 new subdivisions 5-e and 5-f to read as follows:
   5-E.  A. STANDARDS FOR INSTALLATION OF WATER DETECTOR ALARMS REQUIRING
 THAT EVERY ONE OR TWO-FAMILY DWELLING,  OR  ANY  DWELLING  ACCOMMODATION
 LOCATED IN A BUILDING OWNED AS A CONDOMINIUM OR COOPERATIVE IN THE STATE
 OR  ANY MULTIPLE DWELLINGS SHALL HAVE INSTALLED AN OPERABLE WATER DETEC-
 TOR ALARM OF SUCH MANUFACTURE, DESIGN AND INSTALLATION STANDARDS AS  ARE
 ESTABLISHED  AND  DETERMINED  TO  BE  NECESSARY  BY THE COUNCIL. FOR THE
 PURPOSES OF THIS SUBDIVISION, "WATER DETECTOR ALARM" MEANS AN ELECTRONIC
 DEVICE THAT DETECTS THE PRESENCE OF WATER AND SETS OFF  AN  AUDIBLE  AND
 VISUAL ALARM WHEN ITS SENSORS ARE TRIGGERED.
   B.  STANDARDS  FOR INSPECTIONS OF WATER DETECTOR ALARMS REQUIRING THAT
 AN APPROPRIATE AND QUALIFIED  INSPECTOR,  AS  DETERMINED  BY  THE  LOCAL
 GOVERNMENT,  SHALL  PERFORM  A  PERIODIC INSPECTION TO ENSURE THAT EVERY
 DWELLING REQUIRED TO HAVE A WATER DETECTOR ALARM PURSUANT TO PARAGRAPH A
 OF THIS SUBDIVISION HAS SUCH WATER DETECTOR ALARM INSTALLED AND IT IS IN
 OPERABLE CONDITION.
   5-F. A. STANDARDS FOR INSTALLATION OF WATER DETECTOR ALARMS  REQUIRING
 THAT  A COMMERCIAL BUILDING IN THE STATE THAT MAY BE SUBJECT TO FLOODING
 SHALL HAVE INSTALLED AN OPERABLE WATER DETECTOR ALARM OF  SUCH  MANUFAC-
 TURE,  DESIGN  AND  INSTALLATION STANDARDS AS ARE ESTABLISHED AND DETER-
 MINED TO BE NECESSARY BY THE COUNCIL. FOR THE PURPOSES OF THIS  SUBDIVI-
 SION, (I) "WATER DETECTOR ALARM" MEANS AN ELECTRONIC DEVICE THAT DETECTS
 THE  PRESENCE OF WATER AND SETS OFF AN AUDIBLE AND VISUAL ALARM WHEN ITS
 SENSORS ARE TRIGGERED; AND (II) "COMMERCIAL BUILDING" MEANS  A  BUILDING
 IN WHICH INDIVIDUALS ARE EMPLOYED.
