 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   defining supermarket for the purposes of the supermarket excess edible
   food requirement
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Subdivision  1  of  section  27-2218 of the environmental
 conservation law, as added by chapter 63 of the laws of 2021, is amended
 to read as follows:
   1. For the purpose of this section,  "supermarket"  means  a  physical
 retail  store  which  has at the subject location more than ten thousand
 square feet devoted to offering food for human consumption for  sale  to
 the general public AND GENERATES AN ANNUAL AVERAGE OF LESS THAN TWO TONS
 PER  WEEK  OF FOOD SCRAPS PURSUANT TO SUBDIVISION ONE OF SECTION 27-2201
 OF THIS TITLE.
   § 2. This act shall take effect on the  same  date  and  in  the  same
 manner as a chapter of the laws of 2021, amending chapter 63 of the laws
 of  2021  amending the environmental conservation law relating to super-
 markets providing excess  edible  food  to  food  relief  organizations,
 relating  to  extending the effectiveness of certain provisions thereof,
 as proposed in legislative bills numbers S. 6018-B and A. 6562-A,  takes
 effect;  provided,  however,  the amendments to subdivision 1 of section
 27-2218 of the environmental conservation law made  by  section  one  of
 this  act  shall  not affect the expiration of such section and shall be
 deemed to expire therewith.
