S T A T E O F N E W Y O R K ________________________________________________________________________ 9119 I N A S S E M B L Y January 31, 2022 ___________ Introduced by M. of A. GUNTHER -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to making instruction by electronic means available to students with chronic medical conditions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4402 of the education law is amended by adding a new subdivision 9 to read as follows: 9. THE BOARD OF EDUCATION OR TRUSTEES OF EACH SCHOOL DISTRICT AND THE CITY SCHOOL DISTRICT OF THE CITY OF NEW YORK SHALL, UNDER REGULATIONS PRESCRIBED BY THE COMMISSIONER AND APPROVED BY THE REGENTS OF THE UNIVERSITY, MAKE AVAILABLE INSTRUCTION BY ELECTRONIC MEANS TO STUDENTS WITH A CHRONIC MEDICAL CONDITION WHO, DUE TO SUCH CONDITION, MISS MORE THAN FIVE CONSECUTIVE DAYS OF SCHOOL. § 2. This act shall take effect on the first of July next succeeding the date on which it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
