 AN  ACT  to amend the state finance law, in relation to establishing the
   everyone can play grant program
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  10 of section 54 of the state finance law is
 amended by adding a new paragraph v to read as follows:
   V. EVERYONE CAN PLAY GRANT PROGRAM. (I) WHEN USED IN  THIS  PARAGRAPH,
 UNLESS OTHERWISE EXPRESSLY STATED:
   (1) "MUNICIPALITY" SHALL MEAN A COUNTY, CITY, TOWN, OR VILLAGE.
   (2) "RECREATION FACILITY" SHALL MEAN PLAYGROUNDS, ATHLETIC FIELDS, AND
 RECREATION  CENTERS,  TOGETHER WITH NECESSARY BUILDINGS, STRUCTURES, AND
 EQUIPMENT.
   (3) "HANDICAP ACCESSIBLE  ASPECTS"  SHALL  MEAN  PLAYGROUND  EQUIPMENT
 APPROVED  IN  ACCORDANCE  WITH  ACCESSIBILITY GUIDELINES PURSUANT TO THE
 FEDERAL AMERICANS WITH DISABILITIES ACT OF NINETEEN HUNDRED  NINETY,  AS
 AMENDED,  WHICH  SHALL  INCLUDE BUT NOT BE LIMITED TO, PLAYGROUND STRUC-
 TURES, SWINGS, SLIDES, CLIMBERS, AND SPRING RIDERS.
   (II) WITHIN THE ANNUAL AMOUNTS APPROPRIATED THEREFOR, THE SECRETARY OF
 STATE MAY AWARD COMPETITIVE GRANTS OF UP TO ONE HUNDRED THOUSAND DOLLARS
 TO MUNICIPALITIES TO COVER THE COSTS FOR THE CREATION OF HANDICAP ACCES-
 SIBLE ASPECTS IN NEW OR EXISTING RECREATION FACILITIES.
   § 2. This act shall take effect immediately.
