 AN  ACT  to amend the retirement and social security law, in relation to
   waiving approval and income limitations on retirees employed in public
   schools; and providing for the repeal of such provisions upon  expira-
   tion thereof

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 211 of the retirement and social  security  law  is
 amended by adding a new subdivision 9 to read as follows:
   9. NOTWITHSTANDING THE PROVISIONS OF THIS SECTION, SECTION TWO HUNDRED
 TWELVE  OF  THIS  ARTICLE  AND SECTION FOUR HUNDRED ONE OF THIS CHAPTER,
 SECTION FIVE HUNDRED THREE OF THE EDUCATION LAW AND ANY OTHER LAW, REGU-
 LATION, RULE, LOCAL LAW, OR CHARTER TO THE CONTRARY,  A  RETIRED  PERSON
 MAY  BE  EMPLOYED  AND EARN COMPENSATION IN A POSITION OR POSITIONS IN A
 SCHOOL DISTRICT, A BOARD OF COOPERATIVE EDUCATIONAL SERVICES OR A COUNTY
 VOCATIONAL EDUCATION AND EXTENSION BOARD IN THE STATE WITHOUT ANY EFFECT
 ON HIS OR HER STATUS AS RETIRED AND WITHOUT SUSPENSION OR DIMINUTION  OF
 HIS  OR  HER RETIREMENT ALLOWANCE AND WITHOUT PRIOR APPROVAL PURSUANT TO
 SUBDIVISION TWO OF THIS  SECTION.  EARNINGS  RECEIVED  AS  A  RESULT  OF
 EMPLOYMENT  IN  A  SCHOOL  DISTRICT,  A BOARD OF COOPERATIVE EDUCATIONAL
 SERVICES OR A COUNTY VOCATIONAL EDUCATION AND  EXTENSION  BOARD  IN  THE
 STATE SHALL NOT BE APPLIED TO A RETIRED PERSON'S EARNINGS WHEN CALCULAT-
 ING  THE  EARNINGS  LIMITATIONS  IMPOSED  BY SUBDIVISIONS ONE AND TWO OF
 SECTION TWO HUNDRED TWELVE OF THIS ARTICLE.
   § 2. This act shall take effect immediately and shall  expire  and  be
 deemed repealed June 30, 2024.
