Requires solar arrays on certain eligible municipal buildings; defines "eligible municipal building" to be a building which, with no major modification, could successfully house solar arrays; exempts such expenditures from provisions of the tax cap.

 AN ACT to amend the general municipal law, in relation to  solar  arrays
   on certain municipal buildings
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The general municipal law is amended by adding a new  arti-
 cle 5-M to read as follows:
 
                                ARTICLE 5-M
                    SOLAR ARRAYS ON MUNICIPAL BUILDINGS
 
 SECTION 119-MM. SOLAR ARRAYS ON MUNICIPAL BUILDINGS.
   §  119-MM. SOLAR ARRAYS ON MUNICIPAL BUILDINGS. 1. NOTWITHSTANDING ANY
 OTHER PROVISION OF LAW, RULE OR REGULATION, EVERY MUNICIPALITY WITH LESS
 THAN ONE MILLION RESIDENTS SHALL DEVELOP A PLAN TO DEPLOY  SOLAR  ARRAYS
 ON THE ROOFS OF TWENTY PERCENT OF ELIGIBLE MUNICIPAL BUILDINGS.
   2.  IF  THE PROVISIONS OF THE LOCAL FINANCE LAW RELATING TO BONDING IS
 COMPLETED, SUCH SOLAR ARRAYS SHALL BE INSTALLED BY  JANUARY  FIRST,  TWO
 THOUSAND  TWENTY-SEVEN.  BY  JANUARY  FIRST,  TWO THOUSAND THIRTY, FIFTY
 PERCENT OF ELIGIBLE BUILDINGS SHALL USE SOLAR POWER AND BY TWO  THOUSAND
 THIRTY-FIVE,  ONE  HUNDRED PERCENT OF ELIGIBLE BUILDINGS SHALL USE SOLAR
 POWER.
   3. ANY EXPENDITURES NECESSARY FOR COMPLIANCE WITH THIS  SECTION  SHALL
 BE EXEMPT FROM SECTION THREE-C OF THIS CHAPTER.
   4.  FOR  THE  PURPOSES OF THIS SECTION, AN ELIGIBLE MUNICIPAL BUILDING
 SHALL BE A BUILDING WHICH, WITH NO MAJOR MODIFICATION, COULD SUCCESSFUL-
 LY HOUSE SOLAR ARRAYS.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.
