BILL NUMBER: S1704 SPONSOR: GALLIVAN TITLE OF BILL: An act to amend the education law, in relation to employment preparation education programs PURPOSE: To allow English language learning students under the age of twenty-one to participate in approved employment preparation education programs. SUMMARY OF PROVISIONS: This bill amends Subdivision 11 of section 3602 of the education law to allow any student under twenty-one years of age who attends regular day school classes and is designated as an English language learner by his or her school district or BOCES program to participate in an approved employment preparation education program, provided that space, is avail- able.

GALLIVAN, KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to employment preparation education programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 11 of section 3602 of the education law is amended by adding a new paragraph i to read as follows: I. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, ANY STUDENT UNDER TWENTY-ONE YEARS OF AGE WHO ATTENDS REGULAR DAY SCHOOL CLASSES AND IS DESIGNATED AS AN ENGLISH LANGUAGE LEARNER BY HIS OR HER SCHOOL DISTRICT OR BOCES PROGRAM, SHALL BE ELIGIBLE TO PARTICIPATE IN AN APPROVED EMPLOYMENT PREPARATION EDUCATION PROGRAM, PROVIDED THAT SPACE IS AVAILABLE, AT NO ADDITIONAL COST TO SUCH SCHOOL DISTRICT OR BOCES; AND PROVIDED, FURTHER, THAT SUCH STUDENTS SHALL NOT BE INCLUDED UNDER PARAGRAPHS B AND H OF THIS SUBDIVISION. § 2.
